The petition was received by DHS August 2005 , until this day i don't have the result of the review, did anybody went through this?? , how long does it take DHS to review the petition ?

Thanks

Mike

Mike,

I think I've seen it said, by immigration attornies, that re-considering returned petitions is not at the top of the USCIS' priority list. You might try Googling the Usenet newgroup <alt.visa.us.marriage-based> for posts on the topic.

Since it appears that your case is not 'simple and straightforward' - at least it isn't anymore - you might want to see if you can find an attorney who would be willing to help you pick up the pieces. Attornies have avenues of communication with the USCIS that the general public does not have.

Contacting a Senator or Representative may help you get some information about the status of the review at no cost, but a Senator or Representative cannot help you improve your presentation of appropriate and relevant information to the USCIS or consulate like an attorney can.

Expect several months based on what we read here. USCIS may re-affirm the petition and send it back to the consulate and you go through the interview process again OR they may deny the peition, give you the specirfic reasons, etc. At that point you can appeal (not recommended) or file a new petition after addressing the issues which caused your first one to get revoked.
