I know I sound frantic, im just afraid since everything but the actual file and copy of birth certificate is missing that they will deny it and I wanted to let them know that it was a mistake and I have everything else. If they do a RFE I can live with that.

Sorry what do you mean by error? Its wrong what they have on the case status update?

Me too! I agree with stevie b, it can help sometimes. See my thread: http://www.visajourney.com/forums/topic/437536-incomplete-g-325a-denial-or-rfe/. It's not as extensive as this case is, but I believe it worked. LKMK2004, I ran into a similar issue and mailed in extra documentation and got approved without an RFE that I was sure I was going to get. I don't know if the documentation ever made it to our file, but maybe it did and that was why we didn't get an RFE.

Prepare all the items you want to send in and have a copy of them all as well. Send in one set and maybe it'll make it into your file before it gets adjudicated. If it doesn't make it in, you'll have a set ready to go when you get an RFE. I know others may disagree, but I look at it and say it can't hurt to at least try to send it in. When you send in the documentation, include a copy of your NOA1, as well as a cover letter explaining (and apologizing!) the mistakes and what's included in the packet of items.

As for your transfer issue, wait till you get a hard copy of the transfer notice. It'll tell you where it as been sent, which is most likely the Texas Service Center. Include a copy of that as well in your packet.

If you do decide to mail in the items and it has indeed been transferred to the Texas Service Center, the address of the service center is:

4141 North St. Augustine Road

Dallas, TX 75227

I did not address the packet to anyone or any unit in particular, so I'm not sure if you need to do that. I don't imagine that TSC actually has an I-129F unit, since they don't usually process these...

I have not seen anyone get a hard copy for that erroneous local office transfer ... only online

Yes, that's correct; I was referring to the hard copy notice that will come saying it's been sent to TSC.

I only just discovered this site, otherwise I wouldnt be so clueless. The US consulate in Montreal obviously wasnt helpful. I will try sending everything asap I hopes that it will help. If it doesnt I just pray that I just get a RFE and not a denial. I feel so embarrassed for making such an error. They are probably going to look at my file with my one lonely copy of my birth certificate and wonder what the heck is wrong with girl?

Use the forum's Google search function to locate some of those threads and outcomes. My impression is still that the process you describe has very limited success.

With an RFE, the petition has likely been reviewed by a specific adjudicator, and will include specific mailing/routing instructions in order to get the requested formation back to the specific adjudicator. Thereby reducing the likelihood of getting lost in the huge bureaucratic paper shuffle.

I agree that it's very much YMMV and it quite possibly will not end up in the file. However, I am also of the view that it does not hurt to try. As they say, you can't win the lottery if you never buy a ticket.

I have been on for about the same time reading stories even though I did not sign up earlier. I have read stories in the past of success with this but did not book mark them

so what is the harm in trying to cut the head off the snake in advance?? the cost of an envelope?

IMO it is no harm.. generates a little peace of mind, and does have a chance to be matched up to the petition.. although limited, probably, but there is that chance

Glad to help. Trust me, I know exactly how you feel - I felt terrible when my fiancée and I discovered some mistakes in the documentation we sent. Wait until you get the hard copy of the transfer notice though, so you can include that in the documents you send.

I will pray that your documentation makes it to your file too!

I think the odds of it being matched up with the petition are much better than winning the lottery.. was just thinking about that too

Just my two cents of watching threads and pouring over everything I find on the K1 Process.

  1. You won't get denied unless they find something in the Background Check, your petition wasn't signed, your payment wasn't included or couldn't be processed, or you have a permanent BAN that supersedes the K1 visa authority.
  2. Your case has been transferred from the Vermont Service Center (VSC) to either the Texas Service Center (TSC) or the California Service Center (CSC), these are the only offices that handle I-129F petitions, the email contained a generic notification. You don't know for sure until you get that transfer notice. I wouldn't send anything along until you have that in hand and you know exactly where you case is.
  3. You'll most likely get a Request for Evidence (RFE) a week or two after your case is transferred, when you do they'll have an itemized list with detailed instructions on how to respond. Follow these instructions and read up on VJ on how to respond. If you don't send enough information you'll either get a second RFE or a denial. The denial will most likely take place if you fail to provide proof of meeting the primary requirements such as Passport Stamps, Boarding passes, photos, etc.
  4. No need to freak out. If push comes to shove you simply re-apply again. The waiting time sucks since you'll be shuffled to the back of the line again, but it's not a permanent "no".

My personal recommendation is wait for your RFE. You'll most likely get one, so respond to it with all the information and documents they need. Don't worry about getting a denial, sending in the documents now will likely slow things down as they'll be in the system once received and then the adjudicator will have to wait for them to be forwarded and go through a pre-processing before getting to him. With an RFE you'll be sending them much more directly to him.

I agree with those saying do not wait to send it. Copy your receipt, it has barcode on it, so they can match it up. Send the documents to where you know the case to currently be assigned to. Keep copies of everything. You can also call the service center and make a service request. If you send the docs, and for some reason they do not match the docs up, you are no worse off. If you don't send them and wait for an RFE - you will be doing exactly that - waiting. You have nothing to lose by sending the docs. I recently opened a service reuest on our case. They told me to call back in 15 days to be assured that it was completed. Before the 15 days I had expired, I received an e-mail confirming that it was completed. It was a VERY smooth and easy process.
