LCA delays and H1-B extension

Hi everyone,

My H1-B expires on 30th September 2013 and I will need a new LCA as my US role changed. My company hasn't even started the new LCA procurement process yet. Assuming it starts some time next week (may be end of next week), how long will it take for the new LCA to be issued?

I am currently in the US and I don't have any travel plans in this year, so as long as it is filed before the visa expiration date, I should be OK. I know a new LCA takes about 10 days usually, but I am asking as there seems to be a delay in LCA procurement recently for applications filed after July 1st 2013 due to some new prevailing wages released by department of Labor. Do I have enough time to get my extension filed in the coming 2 months?

I think you should be fine as long as your employer files in premium processing. What is the source of your information that the LCA is getting delayed in July?

I am in transfer of H1 process and my employer also filed LCA on 7/10. I am expecting it ot be done in 7 Business days.

you dont need the visa to keep working, you dont need the LCA to keep working, you just need the LCA *filed* (reached in). As long as they file it before your H visa expires you should be fine, and you can keep working on advance parole (I think...thats how it worked for me). Delays dont matter then. It gets problematic if the filing is AFTER your visa expires, that I know for sure. Make sure the LCA salary is within range of what people earn in that job description at that firm or that city. If it is significantly below or above these numbers you get into trouble as well....

check http://www.thesalarypeople.com for details of every H visa salary there is to compare to. I try to raise awareness of this data to stop having to play games with employers. It lists the salaries and not the prevailing wages, and you see that they had to adjust the prevailing wages as the mean salaries went up over the years. The gap between prevailing wage and real mean H salary is remarkable as well, so never settle for the prevailing wage, you will loose $$$, and they play games with you
