Got RFE on 28 june 2013 for K1 visa

on 28 June 2013, we got RFE, and they said we must file the Affidavit Letter of Intent to Marry and must sign and notarize by notary public.

we filer on 11 March 2013 and we use Attorney to handle our K1 visa, and the attorney said this Affidavit Letter of Intent to Marry is new and they doesnt know it. Anyone have the same experience like us?

The letter of intent is not new. Both the petitioner and the beneficiary each must write and sign a separate one. I've never heard of it needing to be notarized though. Is that what the lawyer is referring to?

Letter of intent to marry is not new... both of you have to make one... never i saw in my readings that it has to be notarized.. me and my fiancee submitted this letter (signed by us) but not notarized and we were approved!

I wonder if they are requiring this from those who's applications are prepared by a lawyer or professional. The above two have lawyers doing it for them. So I ask you if you have a lawyer or if you assembled the petition yourself.

We have filed the petition by ourselves, no lawyer involved. But, as i have said, i never saw in my readings that you have to notarized the letter of intent to marry even on the government website.

I must look the website again... now! ;)

We have filed the petition by ourselves, no lawyer involved. But, as i have said, i never saw in my readings that you have to notarized the letter of intent to marry even on the government website.

I must look the website again... now! ;)

You are correct. So that's why I'm wondering if it is lawyer related and a new requirement asked of such applicants who have one.

Either that or some newly trained adjuctator wasn't clear on this requirement lol.

yes, our lawyer ask us to notarized it, and we so depressed as must be delay 1 month because of this RFE :(

we wait since last last to file our petition, but because of we have to wait for tax 2012 done, we must wait until march this year..and now got RFE...

anyone have experience with RFE and how many months delay because of it?

You are correct. It is about a month. I think they are required to process it in 60 days max, but perhaps someone else can clarify that, as I am not sure about that.

As far as what the lawyer asked. Is it the lawyer that wants the letter notarized or did the lawyer want it notarized because the RFE specifically requested it notarized?

We didn't have to notarize our Letter of Intent when we submitted ours at Jakarta Embassy. Most likely the attorney insisted to notarize is so that they can incure Notary Fees ($150) to the OP.

I am using an attorney too, we only signed and put the date on the letter of intent. we didnt notarize that letter.

we have gotten NOA2 on July 15,13.
