I agree, about 90% of all lawyers agree on this. I will be amazingly surprise if this turns out to be otherwise.

Guys....! I just took infopass and went inside the immigration office.

The immigration officer told me that i have to wait until i get my i-130 approved..!

So, there is no choice , i think we have to wait..!!1

I just talked to my lawyer about this, and she told me I have to wait until i get approval of I-130. Till then , I cannot apply for I-485,,,!!!

No, the I-485 says that you must attach an approved immigrant petition (a copy of the approval notice), or an immigrant petition that, if approved, would give you an immediately-available visa number.

My I-130 was approved just now My PD is Oct-12 2012 I am beginning to think more approvals are on the way!!

that's great that you contacted congressman as well. Now that F2A is current, if people with pending I-130 start contacting their congressman or senator, this category will have some attention from USCIS. Keep us posted once you have heard from congressman. If I were you I will still prefer to file on August 1st, worst case scenario is that they will deny your application and that will have no effect on your status nor your wallet...:))

See text below from the website of another repputable immigration lawyer in Minneapolis, Michael Oh

Not only can you file while I-130 is pending but you can file concurent if you are in the use in a legal status.

I cannot beat this horse enough, I have said in the past and I will say it again that the only reason that F2A could never file AOS concurrently was because there were no visas available immediately for this category. Now that there is, there is absolutely no reason why you cannot.

07/15/2013: August 2013 - Heaven for Immediate Family Members of the Permanent Residents (Green Card Holders)

  • In the immigration history, it is rare that the F-2A for immediate family members (spouses and children under 21) of permanent residents is completely opened for one step filing of I-130 petition and I-485 application along with employment authorization and travel document applications. Their current situation is de facto identical to the immediate relatives of U.S. citizens, at least for the month of August 2013, in that the immediate family members can apply for green card, work permit card, and travel document regardless of the visa number backlogs. The quota for this preference category will be wide opened for all nationalities next month! Who would have believed that such a dream would come true! Permanent resident families should timely file the petitions and applications within August 2013 without any flaws in their documentation and petitions and applications so that they do not face a nightmare of rejection of their cases after August 2013. Good luck.

I think it is one year. If you do not get green card within one year of submission, CIS will request for new medicals to be done. I dunno, I read that somewhere I may be wrong....

Once the I-693 medical is completed then it's valid for one year, but, provided you have no class "A" or "B" medical conditions noted (unless a class "B" condition noted under "Other Medical Conditions") and your I-693 medical was submitted with your I-485, then the medical will remain valid for as long as it takes for your I-485 to be adjudicated, even if this is beyond a year.

They are working on november, 2012 PD at CSC cause my got approved today.

Wow good congrats kutko. Are you doing AOS or consular processing. Either way may still be good since they are claiming that F2A will remain current up until October.

VSC is sleeping, my PD is 08/2012 and my case has not been touch for almost a year.
