Guys, F2a is currrrent :)))

I am reading 2 different ideas what to check on the form i485, part 2 - I am applying for AOS because:

A. ...

H. other: PD current while I130 pending

I just talked to my lawyer about this, and she told me I have to wait until i get approval of I-130. Till then , I cannot apply for I-485,,,!!!

No, the I-485 says that you must attach an approved immigrant petition (a copy of the approval notice), or an immigrant petition that, if approved, would give you an immediately-available visa number.

My I-130 was approved just now My PD is Oct-12 2012 I am beginning to think more approvals are on the way!!

Tough choice there. I am going with H since I can write an explanation. But after re-reading A right now, it looks like it would count as well (especially since it says "if approved" at the end). If i hear anything definite I'll let you know.

There are people who have in the past successfully applied for AOS while I-130 is still pending.

Check this link .

The best option will be to check h, and write PD CURRENT AND I-130 PENDING, since it actually gives the basis upon which you are applying.

Note that the only reason that F2a could not file concurently with I-485 was because visa numbers were never available immediately.

IF you look at the employment base category, applicants can file concurrently I-140/485 is a visa is available.

There is no reason why this will be any different from the F2A category.

If your lawyer thinks you cannot apply, you should be looking for a new lawyer right away.

@sam271985 : I've my I130 approved last month but I don't have a visa number yet - I assume I can't apply until I've a visa number. Do you know how long it takes to get the visa number after you get the approval.?

current visa status : H1B.

I130 filed in June 2012

Priority date : June 2012

I130 approved : June 2013

Priority date as of now - current.

Not sure what I should do next? wait for uscis to send visa number or can I send i485?

You do not have to wait if you are in the US...!

Just apply for I-485...!

please update your timeline, so everyone can figure out which priority dates they are approving.....!1

Can you explain why your lawyer mentioned you cannot apply for AOS?

everyone's case is different and it would be good to learn the reason.

True f2a485. Some lawyers are overly cautious and others don't know all the rules. Share the links with the lawyer sam271985. It might help them know how to proceed. Anyway, I hope they start approving those i-130s much quicker. If mine isn't in hand, I'm still applying in Aug. :)
