You can make an infopass and tell them your case ( I 751) is still pending and your extension is going to expire and you need another extension. They will stamp you one in your passport. Then apply the N 400. Take your passport, the extension and your expired green card to the infopass.

The person you spoke to is completely incorrect. File your N-400. This will move the I-751 along the system, and it's possible for your naturalization to be approved before the I-751 is. You'll be good.

What is USCIS fee right now? Do I need to mail 1 or 2 checks?

I dont have much time because i got 1Yr extension letter for my status....and this status will expite in one month

So make an infopass and get an I-551 stamp. It will give you another year.

Only send what i marked in red. The rest is not required.

You also need:

- N-400

- payment

- 2 passport style photos

- Copy of your green card (front and back)

- Marriage certificate

- Divorce decree (if applicable)

My passport expired few month ago and i didnt got new one.

Process to get new passport from my contry of birth is long it will take up to 3months...

Not only the expired conditional green card and expired one year extension notice, but had to send in that I-551 stamp in a current valid foreign passport at that. In the process, not only did my wife receive her ten year card, but so did my stepdaughter. Wife had to give her ten year green card back. Stepdaughter barely turned 18 and had to wait another two years.

For marriage, would send in all the joint evidence you have, many received a RFE evidence because many IO's don't read the instructions. Besides, even if they don't have doubts about your marriage, can say they have and keep you waiting even longer.

If you do not have a current foreign passport, bring in two passport photos and apply for an I-94. Regardless of USCIS delays, still your responsibility to keep yourself legal. They can hold that against you when applying for US citizenship.

Where should I apply for I-94? What I need to do?

I tried E-Request and no luck I got letter they are sorry for delay ...?! that is it

I called USCIS and ask for level 2 offcer I was on hold 1 hour and 20min after short conversation he give me email to follow up i sent an email to CSC after 2 days they reply that my case is not there?!

I sent email and ask where is my case and nobody reply. I called back today and ask level 2 officer I was on hold 75 min and nobody answered and I got disconected......

I really have no idea what to do next....

Is there any attorney here who can give me legal advice what to do next?

sky, I think you are trying to do too many things at once. Calm down and realize that what's done is done, and focus on what's next. One step at a time based on VJ gurus comments here. If you think hiring attorney to do everything for you is better, then go for that because VJ people here would just give you guidance on what to do to save you some $. But sometimes, people skills with research are not the same.

1. Make info pass at your local USCIS office, explain to them about your expired passport and that how to maintain yourself legal with extension of green card. You better be hurry before your status is out in one month. Calling USCIS sometimes is useless, long wait and no face to face, hard to get things done.

2. File for N-400/citizenship, it will force them to make decision on I-751 - there's an official document that states about pending I-751 and citizenship. The operator was completely wrong.

Tells you how, hopefully you have less than a 450 mile trip like we did, but did meet a couple with a 700 mph round trip.

Bring all of your records with you, and two passport photos.

Trying to recall the process, when just getting on during the day, only went two weeks and every slot was full. Someone told me to get on either 3:59 or was it 4:59 AM, keep on hitting the refresh button, and after the hour, some slots would be open. Grabbed the very first one. Someone at the removal of conditions section of this board should help you. Was very very frustration for us and just wasted time calling that USCIS 800 number.

If you call the USCIS 100 times, you will get 100 different answers. At my InfoPass appointment, the USCIS officer stamped my passport and extended my permanent residence status. Since your passport is expired, then they could just give you another letter to extend your permanent residence status. Good luck. I know this must be stressful, so I hope everything gets resolved quickly for you.
