I've seen quite a bit of posts about "the post office returned the notice we last sent you on this case". Some think it's a USCIS's mistake , others think it's a mail carrier mistake.. I have this update for both my I-765 and for my I-485 (2 separate letters). I have received my receipt numbers 2 weeks ago in the same day , have not changed address. I assume it was the mailman's fault, since I doubt my name or address have been mistyped on both letters. I called the office and let them know what happened, they took my information , said to wait 15-30 days etc.

What I'm wondering is - what could have the notices be about? I would have gotten them both in the same time, could it be RFE? Do they request for information at the same time for both? Could it be biometrics? Do people get 2 letters when they receive biometrics appointment notices? Could I have gotten straight up denied for both for some reason? Does anyone know? Please share your knowledge, I am very worried right now.

Thank you

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thank you

You get two seperate NOA1 notices for the AOS and EAD. You then get a bio appointment letter and if you filed for AP you will get a seperate NOA1 for that but no bio appointment letter. If you have not changed your address with tehUSCIS then this is on the USPS because your new immigrant spouse is not listed as an authorized person to receive mail at that address. This is especially a problem if the person is female and has kept their maiden name. I discovered this issue when I sent a card for Woman's Day to my wife from my office. If never arrived and was returned to my office. So I went to the local post office and asked #######? I was asked if her name was on the mailbox. There is also a form the place in your mail box when a government agency--like the USCIS--request the listing of the people authorized to receive mail at that address. We got that after the notice to file for ROC was returned and then the USCIS used our forward order to get the new address. For some reason they did not use the updated address from the AR11 or the I-865 I filed. I send both of those in with the ROC.

Properly addressed mail returned to sender because they are not considered living at that address is defiantely a USPS mistake and you need to get it rectified with the USPS. Then have the USCIS re-mail the notices.

Good luck,

Dave
