Not wrong, but personally I would not advise her to apply for and use the Advvance Parole and leave the country BEFORE she has the greencard in hand.

The AP does not guarantee re-entry......even though in most cases you probably wouldn't have any problems, but after an illegal stay of 2 years, I would feel very apprehensive about trying it :(

No, you've got it right, CWR. If she applies for Advance Parole, it will be given to her. But if she leaves the US before her status is adjusted, she is facing a minimum 10 year ban on returning.

She is taken care of by her cousins (food and a room) and the nanny work is no pay busy work for family only (food/shelter) so it should not be any issue and it will not be mentioned during any phase of this long road.

Small piece of advice for you: Do NOT lie, bend the truth or lie by omission. If you or she is asked a direct question, answer it fully and truthfully.

The penalty for lying is much worse than anything she'd have to lie about.

They did not care one iota about my status when I applied for the marriage certificate. In fact, I don't think I had to show them any id at all.

This will vary from jurisdiction to jurisdiction. Some State, or especially County gov'ts are very full of their ability to now "do something" about the illegals problem in their area.

Checked her paperwork and contacted a lawyer.

Passport (Albania)x2 one in Married name and another in maiden name.

Divorce papers from Canada

Birth Cert from Albania

Green Card from Canada-(CLI) Canadain Landed Immegrant Status

I-94 When arrived from Canada.

So with a Birth cert and passport what states can you legally marry-Just in Arizona/Las Vegas and New Hampshire?

By the way, if she has a canadian green card, why didn't she stay there? Canada is a first world country too. She could stay there, study, work and make money. Well I believe the green card didn't permit her to work and study. But seriously this lady went too far and achieved something from her husband, although abusive, something that people like me probably would have never been able to gain and retain. A green card of Canada! At least she is not a tourist visa victim like me. Nobody ever gave a rat's ####### about me. Nobody ever filed anything for me, nor would anybody ever. Lol sometimes I think I'm one of the most hated persons on earth. I have lots of relatives and families in the USA, Canada, UK and Finland but everybody refused to help me immigrate to a first world country. My uncle in the UK is a general manager of a famous bank in London and I have met him several times and I have also been to 27 countries on tourist visa but hell naw....they just won't change it to something that can later make me immigrant. I was given the quota of tourist visas by God and that's all there is to it. Even if i go in front of a police station and threaten to shoot myself to death if they don't give me an immigrant visa, they will simply tell me to die but would refuse to change my status.

Also it's seriously hard to find a normal (not abnormal and partially disabled) US citizen woman to marry these days. I don't know why. I don't have any diseases. And I work hard and have good reputation. In broadway, manhattan, nyc, everybody knows how honest and loyal I am. The 'social security welfare' girl that I talked about earlier is hugely high-maintenance and aggressive and I'm sure she would make my life a living hell if I finally marry her, although I believe I would just marry her soon and plan my own death because life as an illegal is seriously hard. It's like you're in jail being treated like a piece of worthless #######. If after my marriage to the US citizen, she doesn't file the petition, I'm f up. if after filing the petition, she says she needs 10000-20000 dollars or else she would cancel the petition, what would I do? If after I get the green card (I know I never will, but let's say for example), she says ok let's go to the mall and use your credit card, which you got ONLY because i filed the petition for you, to buy me a plazma tv and stuff and etc etc etc, then what would I do?

I don't have any diseases. I'm entirely a person with almost no mental and physical problems. But nowadays US citizen girls are too proud of their status and become arrogant, cocky and stylish when they meet an illegal alien and find out how quickly the alien would be able to become a green card holder if she marries the alien. I have seen their arrogance with my own eyes.

I hope someday USC girls in the USA would be a little bit sympathetic and compassionate towards illegal aliens from third world countries. After all, if you cut my hand and blood comes out, its color would be red and vice versa! We didn't come here to steal anything from you. We earn more or less than 3-4 dollars per hour doing extremely hard work while you get 15-20 dollars in officers, schools etc (given that apart from citizenship, you have some education too)

If I was the abused wife of that canadian guy, I would have withstood the abuse and continue being abused until my full green card arrived. Unlucky for me, nobody even wants to abuse me in exchange of a green card.

First, Canada does not have 'conditional' green cards. If she had her PR card (the Canadian equivalent of a green card) she already had full status. She could have stayed, worked, gone to school in Canada if she had desired to with her Permanent Resident card. Second, her boyfriend stated that she had family in the US who were able to help her when she found herself in the abusive situation by giving her another place to stay. Leaving an abusive situation is often difficult especially when one has no job or money or a place to go - something that a recent immigrant would not have had much opportunity to acquire. I would never advocate anyone staying in an abusive situation. She made the right move by leaving the abuse.

Her situation is one where she entered the US legally even though she is now out of status. She has fallen in love with an American. If they choose to marry he will probably be able to sponsor her and she may be able to adjust her status to a permanent resident in the US through the marriage which will forgive her overstay and her unauthorized employment. Because of her situation they are well advised to seek some legal advice to ensure that the potential red flags are addressed before they become serious barriers.

Cessna Inspiron, I am sorry that you are finding it so difficult with your life. I wish you the good luck in obtaining what you wish.
