Interview 10th of august... How to reschedule? Deadlline? (merged)

Hello

So we got an email about interview notice on the 10th of august. I won't be in the states during that time so we need to reschedule. None of us are home to recieve the letter until the 31st of july so we don't have any instructions to follow. How late can you reschedule? It says 15 days AFTER the interview date on the site, which really makes no sense.

March 2008 - Met my husband (US Citizen)

10/10/2012 - Arrived to the US on M-1 Visa

01/13/2013 - Husband arrives to the US

03/15/2013 - Got married in NYC City Hall!Received marriage license on the same day.

03/30/2013 (Day 0) - Sent in I-130, I-485, I-765 and I-131

04/03/2013 (Day 4) - Package received in Chicago

04/10/2013 (Day 11) - NOA 1 text(s) and emails received.

04/15/2013 (Day 16) - Biometrics appointment letter for the 7th of May 2013.

04/22/2013 (Day 23) - Successful Biometrics walkin Varick Street, NY

04/30/2013 (Day 31) - I-485 case status updated to testing and interviewing. Still no updates on EAD or AP

05/07/2013 (Day 38) - Biometrics appointment

06/07/2013 (Day 69) - EAD updated to Card production. AP updated to Post Decision Activity.

06/15/2013 (Day 77) Recieved EAD/AP combo card

07/10/2013 (Day 102) Received first interview appointment
08/10/2013 (Day 132) Interview (which we rescheduled because I was out of the country at the time of the interview)

08/24/2013 (Day 146) Notification that our interview has been successfully rescheduled

11/25/2013 (Day 239) New Interview date: 16th of December 2013

12/16/2013 (Day 260) INTERVIEW! - Approved on the spot, will have green card within a few months

When you reschedule, approach with caution and make sure you have everything documented. And also be prepared to come back to the States for August 10th.

I say this because I rescheduled my interview because I was out of the US on an AP, had everything in order, then the local office that conducts interviews did not have that in their system -- so they ended up denying our application because we were considered a "no-show". It took another 2 weeks to sort things out, and the USCIS eventually emailed us with an apology for their error. In the end it all worked out but you have to make sure that you have everything in writing or have a reference number for all the calls you make.

If you want to reschedule, call the USCIS TODAY. Call their call center, and there's a menu for reschedule request. They highly advise against rescheduling more than once. In about 1 week or so, they send you a letter saying that the request was received, and that they will send a new appointment letter when a spot becomes available (It's unlikely, given the timeframe, that you will get the second letter before August 10 with a new appointment date). If you don't get this letter or email in 15 days, call the USCIS again to make sure. Unless you have it in writing that the USCIS approved your reschedule request, don't consider it done. Be prepared to come back for August 10. When you call the USCIS, you may also want to tell the staff there that you are abroad and wants to receive their letters by email as well. Tell them when you plan on coming back to the US so that they can try rescheduling you after that date.

It doesnt say on the interview notice that was sent out only that if we couldnt attend we had to call. We did call but they said that we should send a letter and follow the instructions on the notice! But there are no instructions! We've lookee everywhete on the paper!

So where do we send our rescheduling thingy? To our local office (federal plaza) or somewhere else? And since there's no field or whatsoever for rescheduling, do I write a separate paper stating our reasons?

Please dont waste your breath telling us not to miss the interview and yada yada. We know and all that jazz.

Also, for some reason my husband can't do much since he's not considered the applicant... I thought we both were?

So lets say the idiots at USCIS wont let us reschedule our interview/the rescheduling papers "gets lost" in the ocean of their incompetence,

What happens then? We miss the interview and are considered no-show. What do we have to do to re-open the case? Can I, as the petitioner, be deported? Or can I be denied access to the country (i'm on AP right now).

Or can we refile when I'm back? Do you know what we have to refile? All the papers or just the i485?

You can be denied access to the country- if your AOS is denied, even in absentia, your AP is cancelled.

Send the re-scheduling request to the address on the interview letter. Call again and ask if there is another address, too. Make a note of the time and date of the call, and ask for the person's name. Is your husband staying in the USA? If you do not get confirmation of the re-schedule in time, you could have him go to the interview appointment. He won;t be able to "do the interview", of course, but can bring copies of the cancelation letter.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Also, if I'm denied entry (omg im freaking out now) what happens then? What can I do?

Hahaha, I liked your comments, "idiots at the USCIS" - agree completely. I am in a similar situation now, my interview is in late Febr, but then I will be in Europe, so I have to reschedule. Would you please share how you finally arranged rescheduling of your interview? I can see from your timeline that it took almost 5 months to wait for a new interview date! Your help would be much appreciated.
