APPROVED!!!! AOS from Visa Waiver!!!!

Congratulations clydesdalecouple! Currently going the the aos on vwp process myself! Currently going smoothly (touch wood!!) interview is at the end of May so this was really helpful! Thank you!

London2usa, as others have explained, this process is in place for people that genuinely changed their minds and circumstances! It is illegal to commit the fraudulent act of entering the usa on the vwp with the intention of getting Married and staying!

Let me just give you my situation as an example - last year I married my American husband during my birthday holiday in America. I then went home! I made several visits to America but went home every time. My husband then asked me to come for a long trip over Christmas so that we could use it as a trial to see if I wanted to live here in the USA or if we wanted him to visit the UK for a trial period. So I asked my job for 3 months unpaid leave, had my landlord sublet my room until I was due to go home and put all my stuff in storage, made temporary arrangements for my 2 cats and hopped on a plane and came on over here. After one month we decided that I liked it here and would speak to an immigration lawyer about our options- he told us about the AOS process so we went ahead with that.

So, in answer to your questions - if you are not planning to break the law, then it doesn't matter what you tell the immigration officers at the airport because you should always be truthful. I told them - "I'm here to visit my husband as a trial period of 3 months to see if I like it here enough to stay. My job has been held open for me because I think I'm going to hate it here and be dragging him back to the UK instead!". The officer laughed and said, "good luck with that!".

With regards to proving that we had no intent to aos on arrival, that was easy because we genuinely didn't have intent! I was able to send documentation showing my job was still open, my flat was still available and my stuff was in storage!

Honest and law abiding is the way forward!
