Okay heres the situation..

My wife is a USC and I am a UK Citizen. We got married in the UK last year (wife has a spouse visa for UK), and we now reside in the UK. We decided we wanted to move to the US. so we decided to start the filing process.

We were told that becuase we got married last year and my wife had not been in the UK for 2 years, we needed to file the form in Vermont (although we are currently residing in the UK) (Wifes passport has limited leave to remain becuase she has been in UK for less than 2 years). So we filed the I-130 in Vermont, however today the form was returned to us saying that becuase we are in the UK we need to file in London !!!!!!!!!!!!!....

Refile at Vermont with an US address.

refiling with a US address is lying isnt it ?? becuase we live in the UK ?

So where exactly do you plan to live in the US once you have a visa? Even if you file through the London embassy, they will want some sort of proof that you intend to establish domicile in the US. That usually means some sort of US address.

Then use their address.

Yes. That is her last US address & that determines where in the US she files.

21. If filing for your husband/wife, give last address at which you both lived together...

becuase truthfully the answer to Q 21 would be our address in the UK.. and this would be our true present address

There is a difference between 'residence"and "domicile". "Lived together" may be the same as one or the other of them, or neither.
