Your NOA2 should be just around the corner! According to the London embassy:

As of August 22, 2013, we are processing petitions filed on August 01, 2013.

Hello again.

I have looked into the tax return thing and think we may have a problem here - hoping for some of the usual fantastic advice from you guys :-)

My wife's father has apparently been looking after my wife's tax affairs while she has been here - however he was under the impression she didn't have to file last year as she had no US income, therefore he didn't file anything.

My wife did have a UK income though which she paid UK tax and NI on, and reading up on this if I have understood it correctly, she needed to file and declare that.

What do we do now? I have my medical tomorrow - will we have time to file this before the interview, which I imagine will be around 4 weeks? And if so, does anybody know which forms she needs?

I wish I'd taken an interest in this earlier now, that's for sure, but she just trusted her dad to do it right!!

I'm gathering she's a US citizen, who worked here and paid taxes and NI. However, she didn't mention this on her 2012 tax return?

As far as the forms... does her father have an accountant/tax guy? The best thing, I would think, is contact him or call a local accountant to see what you can do. I'm sure more knowledgable people about the complexity of taxes will help too. I'd create a new post though, so this gets seen. I'm not sure many people will flip to the back page of this post.

+1 catie. She needs to back file that year properly. If her dad's accountant will do it, that's fine. The IRS website should tell her/accountant how to back-file. She might get a fine for being late, but I'm not sure about that.

Yes, she needs to back file her taxes from that year. If her income was less than $95,100 she can take the foreign earned income exclusion (Form 2555), see here: http://www.irs.gov/Individuals/International-Taxpayers/Foreign-Earned-Income-Exclusion

This means she just has to report her foreign earned income to the IRS, but she doesn't have to pay additional U.S. taxes since she already paid taxes in the UK.

Thanks for that, sounds quite straightforward. When I'm less exhausted tomorrow, I'll investigate further - am I right in assuming we just have to fill in IRS form 1040 and 2555 EZ as her UK income was nowhere near the threshold.

Oh, and apologies if this is a dumb question, but where do we send the forms to?

For anyone following along, should update that the medical was done today. Very professional and quick - nice people, from the receptionists to the x-ray tech and the doctor. The 'intimate' part of the exam was way more in-depth than I was expecting, or had read on other people's reviews, and took me by surprise a little but you just have to grin and bear it lol.

And at least now I know there are no problems in that area!

Other than that curveball it went exactly as I was expecting thanks to all you good people sharing your experiences!

If there is the slightest possibility of wanting to return to the UK, she should "get around to it" before you move to the US. There's a pinned thread in the UK forum that explains why.
