Hi. just a quick summary of our case. Came to US on a visitors visa 3 years ago met my husband found out we were pregnant got married and filed my I 130 a month after. I overstaying due to my pregnancy and at the time i didn't have any where to stay if i went back to Jamaica and i wasn't close with m family. We consulted a lawyer due to the fact that many many years ago a lawyer had messed up my husbands divorce papers and he was denied citizenship due to such errors. Our current lawyer said the best way for us to go was for him to apply and i'd go back do the interview and hopefully i'll be back. i have several doubts though. i know i'll need to do a waiver due to my over stay of 3 years. my biggest concern is; (our child though because i have to take her with me. i am still not 100% with my family there i don't feel safe living with a man that molested me in the past. Having my child in that house will have me on high alerts 24/7.)

We sent sent in all the paper work. all we are doing now is waiting for my interview date in Jamaica. then i'll leave the US to attend the interview.

i'm scared they will deny me and i'm also worried that if i do get to do a waiver it'll take a few years to get approved/denied. i wish i could know before i go.. but i don't qualify for the family unity support. since my husband is not a US citizen.

Also, the errors made can be fixed but it may take a few years to get them corrected since he'll have to go to court and have the case (his divorce) appealed or i don't know to get what ever errors corrected. then he can apply for his citizenship again. that would mean me being out of status for several more years. Hence our lawyer suggesting we go this route. Any advice is good as well as encouragement. Thanks.

Dont leave that is the worst mistake ever. File the 485

The OP cannot file an I-485 because her husband is not a US citizen.

they had us file Application for Immigrant Visa and Alien Registration. that was the last thing they asked us to send in along with the original document (marriage certificate birth paper ect.) i cant adjust my status my husband is a LPR

I'm no expert however common sense would suggest you Don't leave cause if you do you probably will not get the chance to come back, wait until your husband situation clears up, that's when you should file you have done three years already why not wait until your case is stronger, having your daughter in the U.S doesn't give you any statue until she is older.

Do not leave. if you they may use the fact that you overstayed on the visitor visa against you and deny your petition. stay under the radar, clear up your husbands situation then file the I-485. Best of luck to you, but do not leave!

Is the errors with your husbands divorce in Jamaica...Y haven't he

fixed or start fixing the problem...seem it could since U R both now

married...red-tape in Jamaica is terrible, but mountains can be moved.

I understand your family situation since U mention the reason U all R not

close...but always have a few ppl of friends that U keep in touch with

wherever U R from because U went to the US as an adult...and U have to

seek a friend before U need a friend.

I would not leave, it may b a long wait in Jamaica, as well as who knows,

a 2nd & 3rd lawyer opinion would be a good idea before getting on a plane to Jamaica
