I am a US citizen but I am living in the Philippines with my gf and her daughter. Since it is now possible for me to file for a K1 Visa and K2 for her daughter, I plan to go back to California within the year so I could start with the process.

Questions:

1. How long should I be in a job before I could file for K1 and K2? Can I file right away as long as I am employed?

2. My gf has never been married, and no contact with her daughter's father, what does she need so that she can bring her daughter with her to the US?

3. Her mom and siblings live in the US. She was not part of the petition since she's over 21 at the time her family migrated. Will this be a problem?

I am really excited to move back to the US and start a new life there with my gf and her daughter :)

File right away. The fastest petitions approved are like 3 months, but usually are around 5-6 months average (mine was 4 1/2 months). Either way, by that time, as long as you make enough such that you have a job that could support 3 (assuming you don't have anyone else you will be supporting in the US), which would be $24,412/yr minimum, which is like a $13/hr FT job. If you have any kind of education or a little drive there's no reason you couldn't make twice that.

Still will need either the notarized letter from the father allowing her to permanently immigrate to the US and to re-enter the Phils to visit and return to the US......or a court document giving the mother sole custody. Is the father listed on the child's BC? If not, then there is no father and you're good to go. Contact the Embassy for what they will want.

Yes you can file while you're in the Philippines and go back and get a job afterwards. For the K1 the financial stuff needs to be done on interview day (I-134) and then later in a binding agreement when your future spouse and her daughter adjust their status (I-864)

The consular officer at the US Embassy will ask your fiancé to show your latest tax forms or transcripts plus you must show proof that you make at least 125% of the poverty level for a family of 3.
