06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I agree it's too high, too. Something like 49% of the country don't make enough money to sponsor someone? Wow. It does sound like there is a giant outcry against this, so I'm hoping it does get lowered.

My SO got a temp position but was looking for something a bit better-paying to save up as much money as possible. I told him that if he gets a job over a certain amount then we're going to drop our K-1 and move there, because otherwise we risk having to wait a really long time for him to get a job that meets the requirements (and then actually working there for 6 months on top of it).

Addendum 2 is just the most confusing thing ever. There are so many sections which seem to imply that there are loopholes to the earnings/time employed requirements, but I don't think so. For example, it asks if your sponsor makes the amount required and the options are "yes" or "no", with "no" directing you to another section. Same thing with the time requirements. It asks if the sponsor has worked in the UK in the past 12 months, and if they've held their job for at least six months, with "no" directing you to questions asking about jobs outside the UK (if memory serves). One of the "no"s takes you to a section asking if you have 16K quid in cash savings. AHHHHHH! It's like a choose-your-own-adventure where you have to pay huge fees and wait three months to find out the ending laughing.gif

I haven't even looked at the form yet. oh man, I hope it doesn't get held against the UK sponsor if he hasn't even been in the UK for the past 12 months to be working! I just thought if my fiance could get a job and could work there for 6 months that would be enough to satisfy the government. And it should really XD

Well, the question basically asks if the sponsor has worked within the past 12 months. I think they still require only six months of employment.

There are a lot of questions on the form which seem to attempt to cover every possible employment situation, so I think the "employed in UK within the past 12 months" thing is a question leading into others (since one of the "loopholes" is if the sponsor was working overseas and has a job offer to work within the UK at most 3 months after their return). My theory is that this is to give information to whoever would be reviewing the file to allow them to make a decision, but if that's the case, then it's misleading and unfair. The US requirements are very straightforward and easy to understand. Then again, their processing time isn't 2-12 weeks, so it ain't all rosy dry.png

That should give you more info than guessing, based on the application form questions.

Thanks again for sending this. It seems to pretty much confirm what I thought, but the examples in the UKBA document did help me understand the questions on the Addendum much better.

I'm not exactly sure which participant in this thread wrote this. The quoting seems a bit odd. Anyway -

"I know quite a lot about this visa for the UK. It's such a pain in the ####, but a really fast turnaround if you meet all the requirements. The financial requirement was taken to High Court just a couple days ago and suggested lowering the 18,600£ to £13,000. However they are appealing against this so I have no idea if any changes will be made. I think it's safe to say that they will drag their feet about it either way. The court declared the amount unjustified and I wholly agree with that."

I feel we should clear up a couple of things here. First of all, I don't think the Home Office has decided if they will appeal. They were given the option to do so, but I've seen nothing to that effect anywhere yet.

The Home Office HAS suspended any application they have in the pipeline, right now, that doesn't meet the income threshold. They will suspend any new applications that don't meet the threshold. They are pondering the Tribunal decision - which wasn't really a decision -

Because the rules were not quashed. They were also not found to be in violation of ECHR Article 8, Right to Family and Private Life.

They were however, found when in total, to be unreasonable and unlawful.
