Hi, my fiance is a US citizen, she lives with me in Australia. We filed for the K1 visa a few months ago and are waiting for NOA2.

Her father is going to be the cosponsor. He is retired and gets money from a pension. He said he surpasses the poverty requirements. So will he be sufficient as a co-sponsor?

I also own a small business with income that could continue in the US after work approval, however it doesn't surpass the poverty guidelines.

Also, is there any "domicile" issue in my situation? My fiance and I live here so we do not have jobs or anything in the USA. We havn't been there in years. We will be having a small wedding there and then renting a place with our savings of around 12-18k (projected by the time we leave for the US). Do we have to prove some sort of "domicile" before being approved? Can anyone help me understand the requirements we might face from NOA2 to approval on these issues?

Well you have to prove intent... Which means you are serious about living there. My husband (USC) haven't lived here for 14 years and all we did was show a social security letter that was sent to his cousins house and we do have a bank account there.

They are pretty good if you do live in another country... They do understand.

At the interview, you may be asked for an I-134, proof of support. The support level at that stage is 100% of the poverty level. However, the level goes up to 125% for AOS. Consider that her father fills out both the I-134 and I-864, which is a stronger proof. Also show on those documents that the father surpass 125% of the poverty level, with income and assets.

As for domicile, just state your intended place of residence (maybe a relative?); and make sure there is a correct mailing address on file wherever that may be. Since you're both moving, stay on top of any address changes, so you dont miss any paperwork.

I'm not sure if I read your post right.....are you getting married in the US or Australia? If you filed for a K-1 then you cannot get married in Australia, you have to get married in the US. If you do get married in Australia then you have to withdraw the K-1 and file for a spouse visa.

12/14/11 Received NOA for I-485 and I-765 (we're not applying for AP)

12/22/11 Received letter for Biometrics

01/04/12 Biometrics in Phoenix

01/31/12 Received email update from USCIS saying that we've been scheduled for an interview

02/03/12 Got an email saying card production had been ordered for my EAD...now just to wait for the card...

02/09/12 Received email saying EAD card has been sent

02/13/12 Received EAD card :D :D :D :D

03/06/12 Interview in Phoenix :).....Approved :D

03/14/12 Received Green card in mail.....

....no more USCIS until December 2013

Yes we are getting married in the US, can't wait.

I just took a look at the I-186, I hadn't seen that before. It looks like alot of similar information to the I-134. I will ask my fiance to ask her dad if he will fill one of those out too.

Yeah the plan is to find a place to rent closer to the date we move, and my fiance still has an active bank account as well, so I guess we will have to find a place before the interview to establish domicile? Anyway, looking forward to getting through this journey and getting married!

You don't have to find a place to live before the interview because they know you live here and you don't have a place. Just use your partners dads address as we used my husbands cousins address and change it when you get there. They told me that they expect that.
