My wife's Philippine's passport will expire in a couple of months and she is concerned about it. Can anything bad happen from her having an expired Philippine's passport? We got married within 90 days using the K-1 visa but we have not filed for AOS yet.

Thanks,

J and G

She should renew her Phil passport ASAP.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

if there's an interview, she'll be asked to show it.

i think she has to submit a copy of the passport bio page also, with the AOS submittal, so what's the worse that could happen?

Submit AOS when the passport is still current, then show the NEW passport on the interview..

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Two things to consider: 1) Right now I bet the passport is her only government issued ID and it is currently valid, but about to become invalid--i.e. expired, 2) what if she wants to travel internationally in the near future? How can she do that without a passport? Once she has the EAD/AP or GC, item #1 goes away, but item #2 remains until she gets a new passport. If she is concerned about it, I think you need to be concerned about it too and find a way for her to renew her passport NOW.

Good luck,

Dave

If we apply for the AOS before her passport expires (exp. Sep. 28, 2013), will the Philippine passport be an issue? Will we need a valid Philippine passport after AOS forms are submitted? Do we need to have a valid Philippine passport for the AOS interview?

Thanks for the help.

You need a valid passport with like 6 months left on it to apply for AOS.

Though, I'd suggest more than that. Mine had 8 months on it and expired.. and I'm still waiting for my GC.
