Great thank you for the update, they are sooo ridiculously backlogged, you would think as much as we pay for this service, they could hire people to speed up this process, before the i-601A these waivers were taking 2-4 months tops. this is soo sad, to hear it is taking so long.

Hi everyone

I filed my waiver on September 23, 2013 few days later I got the receipt i.e on September 26, 2013. Then, Nebraska took 6 months and 1 day, I got approval on 27 march 2014.

I don't know whats next...only thing I know is there will be another interview at New Delhi.

My question is that is this interview is to interrogate me about waiver application of just to collect updated documents like new medical, police clearence and new I 864 etc?

Please shed some light on after approval process. And how it is processed in New Delhi INDIA? Please if anyone knows.

Mexico has different procedure than all other US embassies around the world.

Please shed some light on after approval process at New Delhi INDIA

From what is known, in your country of origin they will look more specifically at financial support and evidence of relationship. They will ask you when you entered the US and when you left. Mind you, THE WAIVER DOES NOT BECOME ACTIVE OR VALID UNTIL YOU LEAVE THE US. Just answer what they ask, DO NOT INITIATE CONVERSATION OR ADD UNNECESSARY DETAILS. If your approval was given for your waiver, you no longer need to worry about the waiver. It was approved and it cannot be revoked unless you break the law in some way. And again, your waiver is not even active until you leave the US.

So now, just worry about having strong financial support (co-sponsors make that a garantee) and a lot of relationship evidence.

Not to sound contradictory, but in fact in most cases before the i-106a, these cases were taking several years. We know at least two people who have been waiting 5 and 8 years respectively. With the i-106a, the cases are actually going a lot faster than before. Initially, most lawyers woud tell us to be ready to wait at least 3 years to get it approved. One of my friends from Boston was approved but was given still 3 years as punishment and she had a newborn son. Just some info.

If you want to know how it goes, just look at your country's embassy. You can also call them. With an approved waiver, you are just like any another immigrant. The waiver means you are no longer ineligible to enter the country. So pretend you didnt have to do the waiver and look up the rest of the process on the USCIS website.

I don't know when your friend filed, but years ago the waivers used to be processed outside of the US. That has changed and now they are processed within the US at the NSC. Before the I-601a existed, they were being processed within 4 months. Ever since the I-601a's came about, the I-601's have been pushed out to 6-8 months while the I-601a's are flying through.

If your friend filed before the I-601's started being processed in the US, ten I can absolutely understand why it has taken so long. Back in 2008 I was about to file a waiver for my husband at that time. It would have been processed in Honduras and the timeframe they gave me was up to 1 year. I was never EVER told 3 years. The embassy told me a year and my lawyer told me a year. ( not SEVERAL years )

The waivers began to be processed in the US in March 2013 (you can look it up in USCIS website). The time frame given was always of 1 year (I was going to do the waiver in 2010 and again in 2011 and both times I was also told a year) What wasnt told was that every case depended on whatever the person getting your case thought was needed. There were absolutely no guidelines nor a way of demonstrating extreme hardship when the person had already left the country because of the extreme anti-immigrant sentiment at the time. The most a punishment would last would be 10 years, but they could also give out lesser punishments. In our experience, and seeing the experience of others, we did not trust that it would take 1 year. Others also had to go to court because they refused to leave their families. Now the process is way better. We have only heard of approvals, with denials being giving to those who entered twice or have some criminal history. My friend had no criminal history and she had entered only once but "they" still gave her the 3 year punishment. That was in 2009. One was taking a huge risk of never being together again or of a prolonged process before the i-601a. Not saying the EVERY SINGLE case was like this, but since we live in almost an exclusive hispanic community, we heard of a load of cases that ended up this way.

Beginning June 4, 2012, immigrant visa applicants who are applying for a waiver of a ground of inadmissibility from outside the United States will file the Form I-601, Application for Waiver of Grounds of Inadmissibility, by mail with a USCIS domestic Lockbox facility, rather than with a USCIS international field office, or a U.S. Embassy or Consulate. The Lockbox facility will send all Form I-601 applications submitted by international filers to the USCIS Nebraska Service Center (NSC) for adjudication.

USCIS international field offices that accept Form I-601 filings by appointment will no longer schedule new appointments for filing Form I-601

Hi there thanks,

I have never been to USA. I live in India. My mother (US CITIZEN) filed the petition, then I was interviewed at US embassy New Delhi in September 2012. They refused my visa under section 212(a)(6)©(i) with eligibility to apply for I-601 waiver.

Then I hired an attorney and collected all hardship evidences and file through Lockbox in September 2013. After 6 months of wait Nebraska sent me approval on March 27, 2014.

Now my attorney says there will be another interview at New Delhi. He says it's going to be a formal interview just to update documents like I-864, medical and police clearence etc.

But I'm scared from this interview thing. That's why I asked what type of interview it is going to be i.e. Hard interrogation or just document updating.

Again, I was speaking mainly about the i-601a, not the I-601. I was commenting on the wait time of both. Did you do the i-601 or the i-601a? Basically, I was saying that from experience and experience of others it seems the process has gone faster now than before. However, not enough time has passed to come to a definite conclusion on that.
