Y does he need a waiver, overstay only? not too bad

one cannot file a waiver until interview the consulate denies

the visa but give U a paper to say U are approved to apply for

a waiver....its discretionary...no garantees.

Any criminal or prior immigration history, requires a good waiver

atty.all waivers requires atty. The atty has to argue the case in a

brief, many hardships shown and each waiver is $585.

Its taking 6-10 mths now for waiver decisions

He has been arrested before for domestic violence and all the charges were dropped and he attended all his classes. and he was also married before who had filed on his behalf and they never finished because they ended up getting divorced. We have a lawyer. but I'm still super worried about everything

Hello, Does anyone have any timelines on how long it takes from when you file the i-601 to the date that you get the approval and the visa??? How long is that part.. thank you!My husband has his appt. for the 25 of February and my lawyer has the i-601 ready. Sooo, the big question I have is how long after that point, if we are fully approved to move forward to apply for the i-601...Thank you!

My fiance was denied his visa last April based on criminal grounds (sentence wholly suspended). The conviction was 26 years ago. We filed the I-601 in June based on the 15 year condition, not extreme hardship. Nebraska still has it in Initial Review. Our lawyer has contacted NSC, as well as my congressman's liaison (multiple times). We are getting no feedback. It's been 8 1/2 months. We are both SO frustrated. Checking similar case numbers, I've found some approvals, MANY RFEs, and one other outstanding case on his NOA1 date. What is the holdup? Can someone enlighten us PLEASE?!

I want to know if the waivers move faster if there is only one waiver filed or is there no difference? We need to file the I601 but still haven't gotten approval from the USCIS (TSC) yet. its been 10 1/2 months. My lawyer told me all waivers get processed at the NSC. I read on VJ that I601's go to NSC and the I-601a's go to TSC and CSC. I wish the USCIS would get their ####### together

if you are filing an i601, it is around 6-9 months average time to approve/deny then another 1-3 months to get visa and come back, if you are filing an i601a then they process in about 4-5 months average.

why does it take another 1-3 months to get the Visa? I would think it depends on the embassy.

why does it take another 1-3 months to get the Visa? I would think it depends on the embassy.

It does depend on the embassy which is why 1-3 months is normal processing after approval of waiver up to receiving passport. With Mexico usually about 4 weeks to receive approval letter, inst letter waybill etc and other countries like El Salvador can take a couple of months after approval to process.

waivers should not take this long to process. This is just ridiculous. It would be nice if they would just process them at the interview. They already have all the info right in front of them. I don't mind paying the money for the waiver, its the lost time I get so angry about. I can't even get through the TSC for my I-130 petition. I am so stressed out over this #######.

I could not agree with you more and I know this is super stressfull. June will be our two year wedding anniversary, it's hard.
