i would think the country report would be what you can print off from the dept of state website for the corresponding country. i added it in my waiver when discussing the pros and cons and comparisons for the country.

Hi Everyone,

I am new to this forum and looking for some advices or help (possible) from anyone who has the same experience.

My husband and I met in 2003, we got married in 2007, and had our first daughter in Aug 2008. Due to his out-of-status for more than 180 days (in 2000) and the denial of his asylum application, the immigration forced him to leave the country in Aug 2009. During those periods, I couldn't sponsor him since I was still waiting from my I-485 application approval which I received through my employer. Then, in Aug 2010 my green card was finally approved. In October 2010, I filed the I-130 for my husband. In November 2010, I resigned my employment to be with my husband and daughter in Indonesia where both and husband originally came from. However, I came here since in 1995. I went to school, worked, and grew here. My husband also came here since 2000. We both used to have a life in this country more than 10 years. It was very hard to go back and maintain your normal life while I was in Indonesia. I was trying to use to adapt to the culture and the people there but it was very hard for me.

In april 2011, his I-130 got approved. However, due to the priority date on the visa bulletin he needed to wait to fill out the immigration visa application. Until April 2013, we finally filled out the immigration visa application and it was approved in Aug 2013.

On October 10, 2013 he had to the US Embassy in Jakarta for the interview but they required him to submit the form I-601 with the reason for being overstayed more than a year while he was previously in the US. I am so very SAD. I really don't how to fell. After all the approval after approval, then they still need more form to fill out.

I am currently pregnant with our third child. I just got back to the US about two months ago. I left my other two daughters in Indonesia because I couldn't take care of myself especially when my due date is next week. My OB doctor told me that I currently have a clinically depression and it may get worse after the baby. I told her I actually had the depression since our family was being a part. It got worse after the second baby while I had to go through the delivery without my husband. And now I will have to do it again with my third baby.

I really don't know what the chance is for us to be together by filling out the form I-601. I spoke to one lawyer in California. She said based on my situation (since I lived in Indonesia and my other two kids are there) my chance might be weak. I asked her how much to use her law office service to help me with the form. She said it would cost at least $2000. Oh man! As I am not working right now, that is a lot of money for me. Too much for to spend on some form that she said it may be hard to get approved. I have asked my OB doctor and a Mental Health Behavior doctor to write me a letter about my condition. They both said that I currently have a clinically depression. But the report was just made recently

(that caused they weren't a strong supporting evidence for my case). I didn't want to see any one before it was because I didn't want people to think I was crazy. I did it now because I had no choice.

My other option is now to wait for another 6 years for my husband to pass the 10-years-banned. However, I am not sure if I can wait that long. The past four years have been very hard for my family and me.

Can anyone here help me giving me some guides/ advices in how to fill the form with some strong supporting evidences in my case? I am thinking of doing my self since the lawyer cost is too much for me to afford right now.

Please help me if anyone is kindly enough to have some cares and understand what we have been through.

Any and all medical conditions from you and your children will help the case I know that's one of the big things they look at and how living in another country will effect that because of treatment you will need and what they would be able to provide

Hi losornio,

Thanks for the info. How should I approch a supporting document in terms of the medical treament in Indonesia? I know for sure their treatment is not advance as in the States. Most hospitals/ doctors will want to make sure they receive money first before giving out their service. A lot of people sufferedand died because of that reason. As you can imagine, Indonesia is the third world country. Are you saying I can just tell the story or what kind of proof in this case that I will need to provide? Sorry I am just so hard to concentrate especially with the prenancy and my whole living situation. Any input will help. Thank you.

Yes flw7277 I would say so because when you write your hardship waiver you have to include all hardships you will suffer and my lawyer informed us that any illnesses or medical conditions should be mentioned

Let your husband go to his interview (if he did , did he get 221G to file 601?) That atty

don't know whats in adjudicators heart U the USC

Write a Hardship letter , it has to be your hardship NOT husband while U

were in his country, the education standard is not up to the US

standard for your kids, the kids being away from U and the new baby

adds to your depression, explain that U tried living in his country and crime stats, substandard medical care caused U to return to US to give birth, Explain from your

heart Y U must have your husband here with U, get all your medical reports & a

letter from your doctor about your depression. You will need copies of evidences

of every claim that U R making also send copies of receipts for monthly payments

of household, food , baby & utilities

OP should get a letter from her doctor about her depression

stating that financial hardships, being away from the family is

the major cause, she also explain she tried living in husbands

country but had to leave due to being unemployable there,

substandard medical care, substandard education for her

kids that R USC leading to her return to the US to have this

baby & make arrangements to bring home kids & husband. Her

current financial situations and how her husband is great help

with the kids and financially if he is allowed to return.

U have to explain all the suffering you are going thru in a letter

and add evidences, pictures of your family, and fill out I 601 form

completely & correctly, also get about 3 ppl to attest to knowing

you both as a couple, his character and how they see him help U,

the waiver should go in with money order for $545 addressed to

Dept Of Homeland Security, then waiver packet mailed to Phoenix AZ

OP U have to prove hardship to U NOT husband they don't care

about him but U have to say in your own words how his hardship

transfers to U...evidences R need for all arguments, pull proofs

off web-site of crimes, un-employment and bad medical care in

that country, Do not wait too long to file waiver also see if U can

get free phone consults from some attys or catholic charities

Yes, all of our children are us citizens but the lawyer said I couldn't use them as my reason of extreme hardship. I spoke a lawyer and also read the guideline of the waiver. They showed that I didn't have a strong case. I just gave birth to my newborn on last Saturday. Everything is so overwhelmed. I really feel like giving up and don't fill out the waiver. Maybe we should just wait for another 6 years for him to come here. As they mentioned, they don't care about the foreigner ;(
