Hi all.

I realized my husband who is my sponsor (USC) made a mistake on I864 (Page 5, part6).

Even though he did not need write my past OPT income, he put. but we did not submit with I-864A.

(He should have wrote only his annual income since his income is already met regulation... :( )

So, it was just a simple error that we did not write anyone (income) other than him (he is only my sponsor)

But I check my case status (AOS) and it said USCIS mailed REF...

I know they mailed because of this error part...

If they mailed REF because of this small mistake, can we just correct and RE-SUBMIT again with letter, which mention it was just error?

*I just went to fingerprint appointment today btw!

One more question is production of my i-765 will delay because of REF???

Please anyone advise...

Are you saying that he listed your past income in the section asking for income from a household member? You, as the intending immigrant, would not need to provide an I-864A. However, in order for your income to be included, it needed to be ongoing and you would need to provide proof that you would still be receiving the income from that same source even after you get your green card. If your income is not current and/or will not be continuing from the same source after your green card approval, then he cannot list it on his I-864. IF that is what your RFE is about, then yes, he can fill out a new I-864 with the correct information and provide a statement that he made a mistake in including your past income.

Yes, getting an RFE can delay the approval of the EAD as well.
