There is no way to know that until you get approved or a notice that your case was transferred to a local office.

Again, you should stop freaking out this much biggrin.png

Like another poster said, theirs took 5 weeks for an approval. Like I said in my first post, the trend is to get a response to your RFE (9 times out of 10 an approval) anytime in a 2-6 week period, judging from other members' experiences. And if you haven't heard in 60 days, go ahead and give them a call because they could have mailed you something and it could have been lost in the mail.

Until you get an approval it is always likely that they may request an interview, but this happens in a small minority rather than the majority of people who get RFEs, and usually there are other red flags in those cases.

Unless your case has red flags, an interview is of course somewhat likely (as it is for everyone else), but not all that likely. Personally, I think that, as long as you submitted all the evidence they requested, you will be getting an approval in the next couple of weeks.

No. They are referring to the actual RFE letter you receive. If you read it carefully, it says that at the end of the letter: that they will review your response to the RFE within 14 days of receiving it, which BTW doesn't mean it will take 14 days, it only means they should look at it within 14 days of receipt. And that if you haven't heard anything after 60 days, then call them.

Mine doesn't say that at all...!

We are also in the same boat, filed our I-751 back in July 2012 , got the RFE on April 18th, replied back to the RFE on June 17th but since then it is already 24 days and no news.

It is depressing and very stressful, most importantly our hands are tied and can not do anything about it. Shame on this slow service, what I can say more..

If you originally filed July 2012, it's already been a year, which means there are a couple of things you can do:

1) You can contact USCIS and file a service request because you are officially way beyond their normal processing times.

2) This also means you have now been a legal permanent resident for more or less 3 years. So your window for citizenship must have already opened or will be opening soon (you can apply for citizenship as early as 90 days before your 3rd anniversary of residency - assuming you are still married to your USC spouse and are otherwise eligible). Many people have done that, even though they had a pending I-751. Because you need to be approved for removal of conditions before they can process you for citizenship, that forces them to look at your I-751 petition and make a decision quickly. Most often this decision is an approval of ROC, and then they proceed to processing the citizenship petition which takes much shorter, usually 3-4 months start to finish. Many VJ members have done that when they were in your situation. It's an almost sure bet to speed things up and it seems to work every time. Of course if you're not interested in becoming a citizen or if you're not prepared to spend the hefty $680 fee at this point, then this may not be an option.

Also, if your one year extension letter is about to expire, be sure to make an InfoPass appointment to have your passport stamped, so that you can have proof of your legal status in the country.
