Address for withdrawing I-864

I'm glad I have the date - I can take some time to think about this. I believe they'll deny him whether I go or not. I have reason to believe he may become vindictive if I'm too aggressive against him. If he will be denied without my doing anything further then I may leave it alone. They have 3 letters from me in the local office already. It may be like poking a stick at a cobra to do any more. :(

I suppose if I provoke him into any kind of documented strike against me then he'll be likely to be deported. But I have a small child, I don't know whether I want to invite an attack.

If you've divorce proceedings going on, it makes sense to get a protective order in place as well.

IMO, showing a protective order, copy of divorce filing, along with yet another I-864 withdrawal letter, should nail the coffin shut (so to speak).

I haven't filed the divorce. Right now he has no legal rights to the baby because the baby was born before we married and my ex was not in the country, so he is not on the birth certificate. He is definitely the father though. He is abusive, so I don't want him getting rights to the baby. If I file for divorce, per multiple lawyers, I have to address custody and visitation. If I do nothing, he doesn't see the baby unless he initiates a paternity proceeding. He won't do that.

There are financial risks to staying married to him. And that stinks. But the custody issues are way more important. I have to protect the baby. So I am not going to initiate anything that ends up with him having time with the baby and maybe stealing him back to his country. It is very, very hard in this state to deny visitation. I don't want to go down that road.

I also can't get a protective order unless he credibly threatens me, which he hasn't done.

I don't trust the family court system as far as I can spit. Right now I have 100% control of the baby - I won't give it up voluntarily...

OP, did you get the withdraw letter done? If not, and you have an appointment drop the letter off, I hate to say but the "desk" did not take the letter because they do not want to deal with it. Did you ask for a supervisor? Did you speak to FDNS about fraud, if there was any, write another letter again for the interview, walk into the local office ask to speak to a supervisor and tell them your situation and give them a copy of the letter. Then get a lawyer, not some chump lawyer, a real jerk of a lawyer, and move for divorce and in the letter you are writing tell them that you have written letters to withdraw the I864 and include all copies of the letters you sent and the proof of delivery. smile.png Sorry for your troubles. You are blessed you live in Texas and no alimony or spousal support and take you immigrant spouse get custody and put him on child support if you have kids, let them remove conditions on your spouse remove conditions on her own.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
