He had to have had reasonable fear of death or great bodily harm. He had a couple of scratches from a scuffle that he provoked. That does not constitute reasonable fear.

I'm gambling that the jury will think it is. Why don't you add yourself to that wager.

i don't get it.

Being a total pussycat is not grounds for self defense.

The more I hear about a 40 second thunder dome match, the more I find GZ's fears ridiculous.

They went 50 feet in under 60 seconds and he was supposedly hit 50 times during the altercation? GZ is totally unreasonable to apply his fear of death based on that time frame and he completely over estimated the blows by a factor of 10. I'd say he lied.

I'm sure in his mind his death was imminent as any child would assume. That's not TM's fault.

OHCrap major typo

No problem...

How do you or anyone else know how he felt at the moment? You don't. End of story.

Let's make a little friendly wager?

If I'm wrong I'll change my signature for 30 days to add the following.

Please disregard my opinion in Politics and Religion, because I've been found to be incorrect in my ability to understand anything to do with those particular subjects.

If you are wrong you will do the same.

Two stipulations.

1. You must post every day of that month or the month starts over.

2. It must be an actual opinion posted with details on the subject in P&R.

Step up to the plate and man up like a good little conservative.

Or just be shamed...it's up to you.

smile.png

I'm not exactly a conservative however I will step up, go all in, and take that wager. Done? If I lose I'll take the well-earned ribbing like a man LOL

Do you guys remember when Kip lost the bet and had to add something to his signature? I think he lost the bet to Evelyn? I can't even remember what it was over, Obama being reelected? Help me out here. But he had the humorous sig for a month and played the good sport about it.

Stop hiding your hating nature. You called the ME a Klingon because he's Asian...........next you're going to accuse him of leaping!

LOL........yep

You used the L word again. Mod action needed.

Her (The clinic NP) testimony was horrible for the defense, because even after examining him completely, she didn't order one additional test, xray, MRI nor add any stitches to close wounds and ordered no followup visit because of the severity.

Her actions alone spoke for the State's contention that the injuries were minor; because if they were severe, she would have acted in that manner and done additional medical procedures.

He was there for a note, not for actual treatment. He stated this on his questionnaire for the visit himself.

His injuries were minor, where was it ever stated that they were severe or life threatening? I thought he just had to be in fear of great bodily injury, not actually have to sustain a defined type of injury. I'd still like to know where in the law it says what type of injuries one must sustain in order for it to be considered self defense. What is the requirement, stitches? Fractured skull? Broken bones? Teeth knocked out? Knocked out. Oh wait, that's no good, someone could easily kill you once you were unconscious. Does self defense depend on length of hospital stay or follow up treatment?

It looks like there is no such thing as self defense, because no matter what, you have to make sure that your attacker fvcks you up so bad that everyone believes you were justified in using deadly force.

I'd like to know how long you, Steven and MBD and others would wait until you decided. How many times would you let yourself be hit? How hurt would you have to be? And what would happen if you got KO'd on one punch and then were bashed until you were a vegetable? How much time is acceptable to wait to see if your assailant stops his assault?

No, no. The FL state attorneys do not know Florida law. VJ teatards know the law much better than the state attorneys.

Do you consider yourself to be part of this group of know it alls too?

A forty second fight? That's their time-frame for this fight. That's fairly insane if that's what the length time was of this fight was before shooting.

Is 40 seconds long enough for self defense or should it be longer? Maybe twelve rounds of three minutes each? devil.gif

Mrs Z says that it's my son on the recording "because it's my son".

Have you ever heard him scream before, "no I haven't"

I'm sold...

Next witness...

That was a great first witness. rolleyes.gif

And Mrs. M heard her son scream for his life how many times? Oh wait, because Mrs. M said it's her son, she is telling the truth. Obviously Mrs. Z is lying, right? I can't believe she didn't say it was TM screaming.

I have done some time tables based on the determined length of the altercation, the location the fight started and the location it ended.

Based on my analysis (and yes I am an analyst...lol) of GZ's testimony and the 911 data GZ and TM had to run at 4 miles per hour (5.87 feet per second) to get to the 50 foot location where the body was found.

That leaves 36 seconds to inflict all the damage that GZ stipulates occurred.

I have a breakdown that I'll follow up with, complete with a diagram of the distances.

My contention is that they ran in the direction of TM's home...they had to to travel the distance that fast from the initial altercation.

I also believe I know what happened based on the evidence and the injuries on GZ.

I've solved the case people! :)

Do you think that TM was running home and then encountered GZ? And will the defense attempt to explain the 50 feet?

No.

I do believe they had an altercation at the T as GZ stated. Here is what I came up with.

For whatever reason the fight starts with TM punching GZ in the nose at the T.

The grass is wet therefore GZ slips backwards landing on his behind giving him the buttocks injury. He continues falling back striking his head and receiving the two lacerations on the head.

TM takes off in the direction of home and GZ gets up and pursues him.

GZ catches him at about 45 feet because TM probably thinks that he's lost the guy following him by knocking him out.

GZ tackles TM and this is when the fight really ensues. At first GZ has him, but TM gets on top and lays a couple blows in on him. Thus the left hand injury on a right handed TM.

After a 20-25 second fight GZ fires his weapon believing he has sustained the justifiable defensive injuries and can now be considered in fear of his life.

This explains the distance, time and the path of the fight. (All to come later)

State rests.

Or maybe you proved self defense? Two times TM got the best of GZ, regardless of who instigated it.

If you follow and then chase someone down who's going away from you, when you know police are coming that's not self defense, not that any jury will give you.
