I am trying to be positive in the whole immigration (GC ) process for my mother.

I am the petitioner and my wife is a joint sponsor . We have both been filing Taxes jointly for the last 10 year.

Because of my mom health condition at time I had to fly back to my home country and stay there for months as I don't have any relatives to support me.

I work as a IT consultant and can make any thing in the range of $45-60/hr. But my circumstances are not permitting me .

Currently I am with out a Job .... and I am showing $ 0 on , my I864 and my Wife is a full time and her income is $85K.

I worked till Nov 2012 and have w2 of $ 45K for a 6 months assignment.

Will my not working be an issue . All our last 3 yrs. Tax returns are 100k Plus.

Really tensed about this. I can't take a job till I complete this process because of personal reason as I need to go back and take my Mom for her medical etc etc,.......a

Please advice...

If your mom is sick then why are you bringing her to USA. She will not have insurance to pay for any medical care or surgery she may need. You do not have a job so is your wife going to pay for the surgery? Surgery in the USA can be up to 1 million dollars for open heart with complications. Minimum 150,000.

Good Luck

With your wife having a well paying job that makes very comfortably over the poverty line, the affidavit of support won;t be an issue in itself.

What may be an issue is that your mom sounds elderly and has pre-existing health issues- it it looks to the CO that she will not be able to work due to age/ lack of English/ medical issues, you may be asked to provide proof of health insurance or being able to cover her medical expenses once inside the USA.

Heath wise touch @ her age she is okay... She just takes the regular medicines for BP and Sugar .The reason I go frequently is that she feels lonely and there is no one to be with her when she has the a fever or some small complication. Like wise I will be taking a medical policy for her before she comes here.

I was only concerned if my unemployment would be a problem .....She is 70 years old...

Unemployment is not a problem per se.

The possibity of her becoming a public charge if she has medical problems may be a problem. Since you are getting her coverage, it shouldn't be a problem.

MyImmhelp,

In the present health insurance market she would not qualify for any coverage. I also believe you wouldnt be able to get her any policy without a social security number. These were my best guesses.

However if you succeed in getting her to the US, as a green card holder she will be eligible for Obamacare and/ or medicaid based on her income, starting January 2014 .

Good luck !

She can't get medicaid until she has been here for five years. If she gets it the sponsor can be sued to pay it back. Obamacare is not insurance, it is requirements regarding mandantory insurance, employer coverage, and such.

Just look at the terms and limitations and then transpose it to what would happen if she had a major cliam.

Short version is that it is ####### cover, but decent cover would be unaffordable for most.
