Hello.

My name is Jonas, And I’m born and I live in Denmark. I’m looking for some advice with the choice of VISA’s in the USA..

The case is, that I’m very interested in moving to the US on a permanent basis. I would be nice if it was in California, the area around LA. I’m so lucky that I met a girl on a vacation last year, and she live around that area, and her and her parents are willing to make some sponsorships for me, if that is necessary.

I’m currently working on an education after I finished gymnasium. The education is called Administrative assistant. It took 2 years, of working in a company, and 20 weeks at a school + Exams. I will graduate in December 2013.

My question is here – Should I look for an internship? ((I’ve heard that they almost never hire international people because of the fee)Unless you are extremely smart) That’s why I was thinking, would it help for me to have my girlfriends family, which can help me financially.
Is my education even enough for the requirement to a “work” Visa?
Or do I have to start at A university to even consider this “work” Visa, as an option? All of this require an employee sponsor though.

Option 2. I could try to achieve the B-1/B-2 Visitor Visas, which allows me to stay for 6 months, which is A LOT better that living so far from each other all year long. OR because I’m from Denmark I can get the 90 days one. But if I want to stay more than 90days, I would have to get the B-1/B-2? But then I would have no possibility to earn money while in USA. After the 6 months expired, I read that you could somehow extend your tourist visa, how? Would a sponsorship by her, or her parents, help me in this case at all?

Or do we have to throw away our dream about an amazing wedding, and get married right away?

With regards to the othe option and questions:

1. I understand that you want to move on a permanent basis. To do so, I don't recommend you try to apply for a B type visa. This visa is for immigrants. If you choose to come on a Visitors visa an then you apply for adjustment of status after marriage, USCIS could find that you entered the US under false pretenses. While you apply for a B type visa, when you tell USCIS that your intentions are to move permanently, they will deny it.

2. I noticed you don't call your girlfriend fiancée. Are you guys engaged? If you are, you can apply for a K2 visa (fiancé visa). That would allow you to come to the US for 90 days with the intention of marrying your fiancée and adjusting your status to permanent resident right after your wedding ( which must occur with 90 days of your arrival to the US under the K2). If you are not engaged and are not planing to get married, you don't want to use this option. If you are planning on getting married soon, this is the way to go.

Remember...Never lie to USCIS, NVC or the embassy during this process.

You're not going to get a real work visa without a Bachelor's and you won't get one for being an administrative assistant. You could try for a temporary work visa for work at Disney or a summer camp or something (the employer would set it up for you). You can't work on B2 so what's the point?

What is the name of the temporary working visa, you are mentioning Harpa?

The point in getting the B2 tourist visa, were to spend some time together with her.

The Department of State website states:

The Visa Waiver Program (VWP) allows citizens of participating countries to travel to the United States without a visa for stays of 90 days or less, when they meet all requirements. Travelers must be eligible to use the VWP and have a valid Electronic System for Travel Authorization (ESTA) approval prior to travel. If you are eligible to travel on the VWP, but prefer to have a visa in your passport, you may still apply for a visitor (B) visa.

USCIS website states:

Initial Period of Stay Extension of Stay 1 to 6 months; 6 months is the maximum Up to 6 months; maximum total amount of time permitted in B-1 status on any one trip is generally 1 year.

The only reason why he would want to get a B visa is if he desires to "visit" for 6 month versus 90 days with the VWP. Either way, he is not trying to visit, he is trying to permanently stay in the US and a B visa is not the right one for him.

On another note, I read my original post again...And I stand corrected for the second time on this topic because I said that the B visa in an immigrant visa when I meant to say that it is non immigrant. I need to keep a close eye on my auto speel from the iphone. Thanks for pointing that out.

You're not going to get a real work visa without a Bachelor's and you won't get one for being an administrative assistant. You could try for a temporary work visa for work at Disney or a summer camp or something (the employer would set it up for you). You can't work on B2 so what's the point?

Disney and a lot of the summer camps seem to use the Q1 visa (cultural exchange). They tend to be fixed term.

It's still a form of employment sponsorship visa. You can't just get one without an employer doing it for you.

Sounds like you had to look up the VWP, did you also look up the likely consequences of applying for a B when VWP eligible?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
