I believe i sent in my original, but I made copies!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

You must send them the original... a copy will not do...

Must be orginal and state on in it that the reason is relocation to be with spouse.

Feb. 15/ 07 --- GC approved

Nov. 17/09 -- I-751 sent (Day 1)

Well, in my situation my company before I left Canada was cool enough to extend me contract until a couple weeks before I left so on the ROE they put that the contract was ended. . . I guess I should have wrote that I left Canada to relocate to be with my fiance and get married. But, I did send them a copy of my fiance visa and my 1-94 so maybe they will get the hint :blink: . But, I did talk to the Out of state claims office and got the same address as what you gave me Canuck Carrie ;). Also, they told me that I needed to have at least 3-5 places of where I have applyed each week so that if the agent phones me they will ask me where I applied although I really can't work because i didn't get the EAD stamp. And the lady said that they are reveiwing my case right now and I applied in the begining of the month. So hopefully things work out. Oh, and I phoned the CRA international Tax Office and asked if there is anything special that I need to do with EI and they said to let EI know that I am as non-resident for tax purposes so that they can take the appropriate tax off (I think it is 25%) the EI payment and then I get a NR4 slip that will be mailed. Hopefully I'm on the right track here cause i'm starting to go :wacko: !!

K1 Journey:

April 13/06 NOA1 from NSC

June 1/06 - Moved to CSC

August 12/06 APPROVED - NOA2!!

August 28/06 Left NVC. . . Vancouver Bound!

September 27/06 Interview APPROVED, with visa in hand

October 29/06 Moving Date

December 30/06 Married!!

AOS Journey:

January 16/07 Sent out AOS, EAD, and AP docs

January 23/07 NOA1's for AOS, EAD and AP

February 13/07 Biometrics in Portland, OR

April 7/07 EAD and AP Received

April 24/07 Interview Scheduled . . . and APPROVED, stamp and all!

May 7/07 Greencard is in my hands!

ROC Journey:

February 17/09 Sent I-751 to CSC

February 18/09 NOA1

March 14/09 Biometrics appt.

April 22/09 Date of Approval!!

June 25/09 Greencard arrives in the mail!

There is a way to get some of that 25% income tax back when you do ur Cdn yearly income tax, wel lsome can, some can't. Off the top of my head, i can't recal how, but was on the income tax software pkg I used. I thought it was too good to be true, even phoned revenue canada. He pretty much said give it a go, if it isn't correct, they wil fix it! lol Got a nice tax refund!!

One is work authorized with a K1, theat's why one can get a SSN card with a K1, because work authorization is incident to K1 status. However, an employer cannot hire you without evidence of that Employment Authorization through an EAD Card.

EI accepts the fact that K1 is Employment Authorized incident to status in terms of paying you EI.. but only for the 90 days. They will stop your payments for the period between the 90 days and the day you send them evidence of your renewed Employment Authorization by faxing them a copy of your EAD.

Correct me if I'm wrong in my understanding of this: I am eligible for EI because of my K1 status regardless of whether or not I received the EAD stamp?

- If so, do I answer "Yes" to Question 4 on the report card "Were you ready, willing and capable of working each day?" (Because I am work-authorized due to my being a K1 but just don't have the EAD stamp or card)

- I applied in mid-November and my I-94 expires at the end of January... so I am entitled to payments spanning this period?

So when my I-94 expires and the report cards keep coming, I should start answering "No" to that question (at which point I will stop receiving benefits) and tell them that I am awaiting my EAD. And as soon as they receive a copy of my EAD, they'll start sending out my benefits again assuming I haven't found a job. If this is how it goes, then that's totally awesome... I had it in my mind all this time that I had to wait for my EAD before I could start getting any benefits at all!

You don't have to check no.. because they will automatically stop your benefits 90 days after you arrived in the US until you fax them a copy of your EAD... then it will restart again... of course if you haven't found a job..

ANd you can get a refund of the 25% non-resident tax that you paid by filing a Section 217 return. You can di this one of two ways

1) If you only Canada source income for the year was EI, then you can file a Non-resident T1 with Section 217 written on the top. As long as your worldwide income is not higher than the 25% tax bracket, you will get a refund...

2) If you were resident in Canada part of the year, and out of Canada part of the year and earned EI, you can file a Partial 217 return...

There are guides on the CRA website on how to file a Section 217 return and they are pretty detailed and relatively easy to follow...

This sounds too easy.. I'm still not wrapping my mind around why the CDN gov. will give citizens who choose to leave the country EI Benefits. But heck! I paid in (and have never ever claimed before).
I'm so curious as to if it works this way. If so, sweet! Can someone confirm this is exactly how it works (and is that easy)? Also, does this apply for both K1 and K3 people?

Hi Misa Yes this is how it works My Sister inlaw works for EI here in Nova Scotia I had her check into the out of Country filing awhile back and it's all allowable If I rememeber correctly she mentioned something called Interstate claim and it's handled in Belleville Ontario

Ok, I am totally confused.

As a K-1, I am eligible to collect EI? And if so, from who? The US or Canada?

Since it appears that I will not get an EAD stamp because I am not going through JFK, how does affect my chances of getting EI?

Is there a guide on this somewhere? If we could get EI while I am unable to work for 90 days pending my EAD when I get down there, it would save a ton of money problems for us. EI has been scooping chunks of my paychecks long enough-- I want some of that back if I can get it!

22/11/2006: NOA2 - APPROVED!

31/12/2006: 1 year anniversary

I'm in the same position as Galateia... who knew I could get EI from Canada when in the US!! Wow!! Could someone more knowledgeable outline how this works for us... or point us in the right direction??
