Help with Front loading an I-130 spouse petition

Hello All,

What is the extent of front loading that is acceptable? Should I just provide a few marriage pictures and some chat logs? I don't want to inundate the application with relationship proof yet I dont want to fall short either. Can you all advise?

We just put in copies of our marriage certificate, my divorce decrees, our son's birth certificate, joint lease, bank statements, joint utility bills. We've been married and living together in Australia since 2011, so that provides evidence in and of itself. It really depends on which country your wife is from and what evidence you have of a real marital relationship.

Go atop any VJ page and click the links for "Embassy Info" and "Reviews: Embassy." Read, very closely, the information and reviews for New Delhi. Pay particular attention to the worst stories of interviews (denials, 221g, gone awry). Consider what you can add to the petition now to head off trouble later. Then, look through the India (South Asia) regional subforum for pertinent reviews in threads.

The Indian consulates aren't easy. At many if not most consulates worldwide, the consul has a decision in mind before the actual interview.

With this in mind, and whether or not the U.S. petitioner is allowed in the interview itself -- allocate the funds and build the free time so that you'll at least be able to be on the consular premises or very nearby outside when the interview eventually occurs. Many a tough interview (and we'll never know exactly how many) has been made easier by the petitioner's handing his U.S. passport to his wife so that she can stick it in the consul's hand before the first greetings are over. This can turn a denial (in the consul's pre-interview mind) into a fighting chance, and a borderline chance into an approval. In some consulates, it can even result in the petitioner's being invited in to the interview, which increases your chances of success immeasurably.

In addition, look through the Vietnam regional subforum for information on creating a "timeline of relationship." This is an exhaustively detailed document that yields evidence of a bona fide relationship. It's essentially necessary there, and it can be helpful for you to include something like this in your petition package. USCIS will not care about it, in itself, but they will pass it to the consulate upon approval of the petition. The consulates are not supposed to deny the existence of something that they know USCIS has seen. Maybe some of the Vietnam members here -- and there are many good ones -- can come along and add their thoughts to your thread here.

Come interview time, I would also recommend preparing an updated "timeline of relationship" that your wife sticks into your U.S. passport that she hands to the consul.

Beyond this, include pertinent e-mails and evidence that includes supportive information that you want the consulate to see. If the size of the petition package intimidates you, envision how it will appear to a busy consul.

You're very fortunate and wise to ask about front-loading before you've submitted anything. Front-loading for a difficult consulate is a chance to make your case strongly so that the interview becomes less perilous.

EDITED TO ADD: Harry, your post is in the CR-1 forum but your profile says K-1 and that the interview has already occurred. If you're preparing to front-load an I-129F petition, the advice above changes. Were you refused a fiance visa and you're now preparing a spousal (I-130) petition?

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Sorry. I have posted before and I keep thinking everyone knows my story. My fiancee is in India. The consulate is New Delhi. So it is very tough. She was denied a K1 so we got married in June., .


Darnell, why do you advise against front loading? Whats your rationale?

Didnt realize you were being sarcastic. I am going to front load. Just not sure how much to do. Are pictures of the marriage sufficient? I have a marriage certificate and several pictures of us from then. I guess I will go ahead and include everything about our relationship from the beginning. I had been separate from my ex wife for 3 years. However, I only divorced her in May 2012 and filed a K1 in June. This may have caused the K1 denial. I will go ahead and get an affidavit from my ex wife stating that we were living separately since FL has no legal separation.

I think you are mistaking the definition of "front loading" front loading does not simply mean to supply evidence.

We all are supposed to do that.

Front Loading literally means supplying a LOAD.

Some of these people provide enough evidence that they have to ship their petition in a box instead of an envelope.

I won't give you any advice because I'm not familiar with your country/situation, but if someone tells you to front load, they don't simply mean to insert a few pictures and phone bills.

Front loading is painting a picture of the relationship between the two of you. When you say you talk daily you provide proof of it , not just a few calls but calls every day for months or years. When you say that you know the family you provide pictures at birthdays and weddings and dinners. You proved statements and tickets and hotel reciepts,

This will not be over quickly. You will not enjoy this.
