Hi,

I'm about to submit an I-130 petition for my wife here in Taiwan. We want to file for the IR-1 visa to enter the US. We will have been married for 2 years in December 2013. Is it OK to start the I-130 application now or is it too soon (considering the 2 year condition of the IR-1 visa)?

What do we need to do once we get into the U.S. on the IR-1 visa?

Thanks so much!

Brett

The cr1 and ir1 is the same paperwork so you can go ahead and file... If at the time they enter the USA (at the POE airport) they will change to IR1 ... But be sure to remind the CBP officer at The airport...

This is correct. It is the same paperwork exactly. If you have been married for 2 or more years at the POE then you are an IR1. This journey normally takes 6-12 months (10 months being the average) from start to finish. The beneficiary then has 6 months from medical or visa date (varies by country) to enter the USA.
