Just got my e-mail that the I-130 has been approved. Now the dilemma of figuring out which way to go. It seems interesting to me that the I-129F and I-130 got approved one day apart. I've noticed from reading this board that it has happened similarly to other very recently. I wonder if this is random or there is some correlation, even though different service centers are processing the petitions (in my case, California and Texas).

I know that personally I would pursue both options until one of them reached the consulate, but that's just me

yeah i have been watching this happening quite often lately...i think it may have something to do with the reorganization of the USCIS...first all cases being transfered to CSC or VSC...they may be consolidating investigation between the I-130 and I-129s...make organizational and financial sense (but wait we are talking about the government here...lol)

it would be a dream come true for all the new petitioners for this to flow like this from now on.

Congratulations! Yes I am one of the lucky ones who recently had both the 130 and 129F approved on the same day (11/15/06). But in my case they read my I 130 wrong and said they were holding it because (they say I wrote that my wife was already in the US) WRONG!

But I decided just to go ahead and persue the k3 VISA for two reasons, one being that they will take longer to process the 130 at NVC with all the additional forms and bills etc. and the additional expenses that you have to put out just to see if it would reach the embassy faster then the K3 VISA. The K3 should be processed through the NVC in approximately 2-3 weeks, but I have yet to receive my case number, but I am hoping maybe by this friday I will call and find out it has been received and forwarded! Good luck!

Thanks, good point! I did call them initially when I received the hard copy and read this comment and complained that they were forcing me to spend an additional 200.00 dollars (Request for Action Form Fee) for there mistake, that I had an exact copy of what I had sent them and read it off to the guy that she was not in the US and that the VISA issueing would be conducted in Bogota. He said all I needed to do was to send a cover letter and copies of the I 130, I 797 Approval and they would forward it. But I figured I would not waste my time and just pursue the k3 and AOS when she arrived! I will call them again and ask if I need to do anything to prevent problems later if I do nothing with it at this point. But thanks for the heads up!

I have had a sneaking suspicion and it is starting to be borne out. I have noticed on another board that I came across that there are those that have had the I-129F approved and then the approved I-130 is being held for AOS in the US despite what one has put on the I-130 to apply for a visa at consulate abroad. I have a feeling that we are going to see more of this over the coming weeks. They look like no longer giving the option to either enter on the K-3 and go back to the consulate unless they pay the extra fee and file the I-824, nor to take both paths through unless filing the I-824 and fee. I hope I'm wrong but its sure looking that way.

I am one of the lucky people who had both of their petitions approved a day apart. I called a week later and the NVC gave me my case number over the phone. They told me that it would be between 2-4 weeks before they send it on to South Africa. Good luck to everyone. It's soooo great to see so many fast approvals coming through.

I am aware of the press release of the new process but not a bad idea for it to be reposted, thank you. The new process is what I was referring to in my post with the addition of what is NOT included in the press release. There is no mention of the USCIS retaining the I-130 when one has selected in that they wish to apply for the visa at a consulate abroad and the I-129F has been approved or forwarded to the NVC. That is the sneaking suspicion I have had after first reading the press release a week ago and that is now appearing to be the case.

You are right about your suspicions! However, in my case it says in the body of the hard copy 130 Approval that I indicated my wife was in the US and therefore they were holding my petition and that I must file a Notice of Action with $200.00 if I wanted to have it forwarded to NVC. But as I said in my earlier post, I clearly indicated that we wanted the VISA issued in the Bogota Colombia Embassy on my I 130. So when I called to clarify this point and complain about having to pay this fee based on their mistake the representative said I did not have to file the Notice of Action $200.00 fee. He went on to say I should write a cover letter explaining my point and include my copies of the I 130 showing my intentions and the associated Approval and they would correct the issue and forawrd it on. But as I say I am now only persueing the K 3 VISA route.

But as the previous poster said if I do not call or do something this may present to be a problem when we file the AOS later on. So I plan to call them again just to make sure I do not need to do something else with this wrongly adjudicated I 130.

I am doubtful that the person you spoke to at the NCSC will have given you correct information. Going by past implementations of new procedures (IMBRA comes to mind of most recent), those at the customer service center were amongst the last to know anything. I would be surprised if they are up to speed on this new implementation.

I am curious as to HOW you not responding to the NOA2 will cause any problems. It asks you to respond if you wish it forwarded to NVC. If they have no response from you, it will be transferred to the new records center until you apply to adjust status from the K-3. It is not going to effect your K-3. This is the new system. What I think they have done, I am assuming here, is taken your approved I-129F as indication that you will be adjusting status in the US on your K-3. This was a part of the news release that left a gap, and ever since reading it have wondered what was going to happen in these circumstances. For confirmation of what is happening, we have to wait until more experiences are shared.
