Hello,

3 weeks ago our AOS was received by the NVC.

Yesterday they reviewed it and said that we need to send the most recent tax return (2012) and that No. 19 on the i-864EZ is wrong (we noted tax amount 2011).

We sent my husbands most recent tax return (which is 2011) because he´s been deployed for quite some time and has an extension to make his 2012 taxes till 2014.

We sent the i864ez, his deployment orders and a letter from him saying that he has an extension that is offered to deployed soldiers by the US government. There is no official letter from the government that they get reg. the extension, it´s a "rule/law".

NVC first rejected the AOS and told us to send the 2012 stuff, which is not possible. So I called and they told me that he needs to send a letter stating that he has a extension. I told them they already have that letter over there and that it was sent with all other required AOS documents. They still refuse to open the case back up. They are going to open it back up, if I send the extension letter again that they already have and once the mail gets there it´s going to take another 2 to 3 weeks for them to check it again.

We do not have so much time!!

I do not understand why they don´t help us out here? The mistake was clearly on their side. We sent everything they needed.

We have expedite processing and still nobody cares as it seems.

Does anybody have an idea what else we could do?

Hello,

NVC sent us an RFE and requested to send certain documents that we have already sent. The were in the same package as the other things which were ok for them.

I do not understand it. I asked them on the phone to recheck it but they still said to send the "missing" information and than they will review it again.

What can we do??

We have expedite processing for a reason and no time to waste on this...

I undestand your sentiments but I practically suggest that you give what they are asking... since you have said you don't wanna waste anymore time with this... so you must act ASAP!

Anyways, since you have submitted it already before I am sure you can provide it again in no time! :)

You´re right and I already put it in the mail this morning but it still delays the case about 4 weeks and we absolutely do not have time for that.

They refuse to recheck, if they have my husbands letter that explains why we only have 2011 tax information and also 2011 tax menitoned on the form. We are not able to provide 2012 tax nor do we have to due to deployment rules of the US government.

They do have everything they need...yet we have to send something that they already have from us?!

For "Most Recent Year" You put 2011?

If so, you screwed up, not them.

For "My individual annual income is currently" you put for 2012?

no we did not screw up and even nvc thinks we did not screw up. yet we have to send a letter explaining why 2011 is the most recent year, although they already have that letter. It was sent in one envelope with our other documents.

military / us government deployment rules for tax: 2012 taxes are due in April 2014!!

Therefore most recent in our case is 2011.

Have you talked to a supervisor at the NVC? Perhaps you can email them the extension letter with their name and supervisor review in the headline. I would try anyhow.

and KDH is right, they don't care if you have an extension, that's fine with them. However they want the form filled out in the format they're asking for, which you didn't do.

When did you send you i-864or checklist?

We sent it about 4 weeks ago.

I did talk with a supervisor again last night. She said we do not have to send anything else again since it will just postpone the process further. She is going to check our case again in the next 2 weeks. I asked her about the "most recent tax year" and she agreed that we are correct and that it is more important that my husbands fights for their freedom than makes taxes in time and that this is what the extension is for...

How do you think it makes sense to not overnight something to them to satisfy the checkilst, but instead wait 2 weeks to check your case file?

YOU THINK?

I repeated what the NVC told me. I assumed they know better?!

NVC told me yesterday that sending something does not make sense because I might not need to send anything else. It´s going to take another 20 days till they check it just in case I do send anything.

So why should I do it?
