Medical package ready + Need help on other forms!!!

Hello everyone,

My husband and I recently came back from my designed CS medical appointment, the medical form is completed, paid for, sealed and ready to be sent. During the medical appointment all went well, I got the vaccines I needed to get done, etc, all is completed. All we need to do now is send the whole package but we are having trouble filling out some of the fields on some other forms.

Forms I-765 (Application for Employment authorization) + I-130 (Petition for alien relative):

  • Question 10 on first Form: Alien registration number (A-Number) or I-94 Number (if any):

---> What is "Alien registration number", I have no clue what it is!! + I never had any I-94 paper handed to me by anybody when I arrived on US territory in 2011. It says "if any" so it means it's not mandatory, right? But what about Alien registration number?

ALSO

  • On form I-130 they also ask at question 14 my arrival/departure record as shown on Form I-94 + Date authorized stay expired, or will expire, as shown on Form I-94 or I-95

---> This time there is no "if any" and the question is in bold letters, which indicates it has to be mandatory...???!!? I am lost because I have absolutely no idea what to put.

  • And this detail: + they also simply ask, right after that: ("Date arrived:" ---> Do I fill out only this field and not those related to I-94 and 95???)
  • In Form I-765 they also ask at question 15 my current immigration status:

---> I came as Visitor but this status expired long ago, (again here no special paper given to me, just an expiration date stamped on my passport when I arrived on US territory) what do I put here?

  • Question 16: I have no idea what to tell and yes I have read the instructions linked to this form, I printed all out but I simply don't understand any of it.
  • They ask me to tell my I-94# + my current USCIS status and expiration date again in Form I-485 and I still have no idea what to say here.

I am sorry I have so many questions, I tried really hard to do it all by myself at first (my husband who is a US citizen doesn't understand any of it and is as freaked out about it as I am) + we even got the help of a lawyer a few times, months ago but I still don't know what to answer in those fields... the idea of us being separated is scaring, we really want to do the right thing and complete everything the way it's supposed to be, so we tried on our own but can't complete those points. Hope you can help, our anniversary is on November 27, this year it will be 2 years we got married and been living together, we have been inseparable since I arrived, we just want to be done with sending these forms but don't want to rush into filling it out the wrong way, because we have been told it could be a reason to be denied.....shocked.gif So please help us. Thank you

  • And do we forget any other form? Do we need to fill out the WORKSHEET attached to Form I-765 as well?
  • In Form I-130 at question 19 they ask my address abroad, thing is my husband and I have been living together since 2011, so do I still fill out my former French address even though I haven't lived there in years or just say "None"??

The lawyer we consulted for help with these forms told us we had to fill them out, but before I could print them out, bring them to him so we could work on them together we had a problem and could not get help from him anymore, which is why we are here now...

You probably do not have an A-number, in which case you leave that blank. You'll be issued an A# once you've filed the AOS, and after that you'll reference that number in all immigration related issues.

You also might not have an I-94 number, depending on what visa you came with. My understanding is that I-94s are becoming more and more obsolete, so chances are you may not have one - though personally I do remember receiving it every time I entered the US in 2011.

What visa did you arrive on? Date authorized stay expires is the date when your current visa expires, or when your authorized stay under VWP expires if you came as a tourist under visa waiver. Whether or not you have an I-94, you should have a stamp on your passport with the date of your entry to the US. That is your proof of legal entry and your "arrival record".

If you came as a VWP tourist, your current status is still VWP. You can also put "VWP, overstay".

Question 16 is (c )9. You are an Adjustment of status applicant, correct?

Expiration date is, again, whenever your current stay expired. You might not have I-94, though you may want to make sure you really don't have it. Make a copy of the entry stamp on your passport for all forms that request proof of legal entry and/or arrival record.

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

Don't freak out, the answers are actually pretty simple. smile.png

  • Question 10 on first Form: Alien registration number (A-Number) or I-94 Number (if any)

If you never got involved in a US immigration process before (fiance visa petition?), you don't have any Alien number.

You said you arrived to the US as a visitor. Did you enter using the Visa Waiver Program? If yes, then you don't have a I-94 form. So you just write "None".

If you entered using the VWP, write your date of arrival and the date until you were authorized to stay (most likely 90 days after arrival).

Well, you have obviously overstayed so you don't have any legal status in the US. I would write "VWP expired", or "Out of status", something like that.

I am not sure what worksheet you are talking about.

I-130: If you don't have an address abroad anymore, write None. This form is also used for spousal visas, so this explains why they ask for an address abroad.

Do not file for a I-131 (travel authorization), you have overstayed for too long and you should not travel out of the US until your AOS is approved.

Great, thanks guyssmile.png It's simpler than I thought it would be. I came as a VWP tourist and yes, I am applying for Adjustment of status. I have one more question though, on Form I-485, (Application to adjust status) on Part 2. Application type, they say to check one answer but I don't fit in any of the situations explained. So I wonder, do I check the box "h" (Other basis of eligibility and At Explain, should I just say: "I am applying because I am an immediate relative of a U.S. citizen -spouse-" Is it enough?) --> We are going to join certificate of marriage and marriage licence as well.

(Ps. Now that I know I have to answer ( c ) ( 9 ) I don't need to complete the worksheet linked to employment authorization form).

You need to check box a. The immigrant petition is the I-130 that your husband will fill in concurrently.

No need to send a copy of the marriage license. The marriage certificate is the actual proof that you got married.
