Hello Fellow V'Jers,

Today I received the most confusing and unsettling news. We had our interview on May 28th. At the conclusion of the interview, my fiance asked the CO if everything was ok. The CO stated yes you are approved you just need to following these instructions. The CO handed my fiance instructions for registering for DHL delivery and kept his passport. Later that day when we got back to my fiance's place, I emailed the embassy a copy of a screenshot showing we had registered for DHL and requested Mo'Bay as pick up. I then emailed the embassy two more time asking about a status. Finally on 6/21 they responded with your case is undergoing adminstrative processing and they would be contact.

Well today I contacted DOS to inquire about the status of our case. I was told our visa was denied under section 221(g) and my fiance was given a sheet of paper at the time of the interviewing indicating the denial reason. I explained he never was given anything other than DHL instructions. The rep stated that by law they should have told him the denial and proved him with the reason. After that call my fiance insisted I call back and speak to someone else. The second rep I spoke to stated he did not see no 221(g) in our case notes which case notes are entered by the embassy. I called again, spoke to another rep who said the case notes do not state 221 (g) but the case is coded as such. When I asked why would they have taken his passport if they denied the visa he said because its a "soft" denial and often times if they take the passport is because they see the applicant is eligible but needs to go through further processing. This rep affirmed this should have been explained to my fiance at the interview. Then I called a fourth time with my fiance on conferene because he had questions. The fourth rep confirmed 221(g) and stated it is something everyone goes through. (I think she said this because my fiance asked if everyone goes through this), I then asked her about whether or not the law requires the embassy to inform the applicant at the time of the interview if they are denying with 221(g) because I will be in contact with my congressman office and I wanted to ensure I was stating facts. She placed me on hold while she reviewed the Foreign Affairs Manual. After she finished reviewing she stated they are supposed to notify him, however the notification can be orally since the fiance visa is classified as NIV. She told my fiance he could contact the embassy and ask them to issue a letter with the denial reason.

Our case has had 5 updates when we check the ceac site. Each time our status says "ready" not "administrative processing". The immigration specialist with my congressman's office is in tomorrow so I will be speaking with her to figure out how this can or could be remedied.

Here is where I need you fellow V'Jers, is this normal? Has anyone seen this happen before? I am still hopefull this is some error with data entry since DOS confirmed our case notes do not state anything about 221(g) and only that our case is coded as such. Also, that on several occasions when I called DOS I was told no decision was made on our case and it was under administrative processing.

Please any opinions, oberservations, or even support is appreciated.

I am no expert... just thinking here ok...when I read about the

process its states everyone being checked for immigration goes into

regular AP, some ppl have a bump in the road due to name hits...when

this happens more checks are done and the process take longer...lets

say hubby name is John Henry DOB 1/9/85 and a similar name comes up

maybe the person born same mnth and yr....it could be a soft 221G, but

there was not concrete proof at interview, so otherwise everything was

OK...as long as there's no issues in his background to have him require

a waiver & all documents turned in is valid, it will work out...just pray

and contact your congress-person, Jamaica reviews shows those getting an

immigrant visa is given a green card receipt , did he get that? ...goodluck

wow.gifranting33va.gif Yes, I would definitely get someone involved. Confused on what you mean by no case notes of 221g, but coded. Are you saying that DOS verified that you are under 221g, but they do not know why, from what they can read? Even if it is a soft denial, it should have been explained. Everyone does go through additional processing and that is called AP. All I can think is did he fail a drug test? Has someone applied for him before? I would e-mail the embassy and demand a phone call, and an explanation of why 221g was given. If they send it back to USCIS, it will be reviewed and they can re-confirm your approval. It just sucks that this process will be extended. Hold tight, you and your fiance will get through this. Make sure you keep us updated, so we can try to process it.

Make them e-mail you a copy of the 221g now.

Thank you. I emailed them immediately after the first call. He past his medical and no drugs. This is his first petition. I am in good spirits and am faithful this will be resolved rather quickly.

He was told approved and given a green stub. A fellow VJer who POE on Friday confirmed the green stub was what their fiancé received at his intetview when he was approved.

Either the CO made a huge oversight or some one in the admin processing unit entered his case incorrectly. Either way this embassy has to answer to this.

Yes my fiance got a green ticket stub attached to DHL Confirmation Instructions sheet.

I sent off my inquiry to the congressman's office. I was instructed it would take about a week to get back to me. fingers crossed!

Wow...this is very odd. Hopefully you get some resolution soon.

I hope so too. You suggest odd, what makes it odd? I'm curious. As you know this process is super confusing and vague. I would like to understand what to really expect with this process.

USCIS employees R humans, at times they make mistakes

to others detriment, I hope your next answer will be

positive re: this matter, CO could have hit wrong button,

considering he gave him green receipt and dhl flyer, they see

many people on a weekly basis...stay strong, stay positive sis.

I can not believe this - my heart goes out to you! Obviously, an error was made but how horrible to have to go through on top of everything else - I keep you in my thoughts daily and hope for a speedy resolution!

Thank you. I really am trying to be as strong and as positive as possible. I miss him terribly and had hopes he would be here already. I can only continue to pray.

how often would any of you suggest I email the embassy? I sent them an email on Tuesday when DOS said its under 221(g), I have a scanned copy of what he received at the interview. When could I email it to the embassy. Their email says wait 5 business days. I submitted on 7/2 which is 2 buisness days now (i heard they were closed on the 4th). I sent everything to my congress-person's office on Wednesday (including the scanned copy of green stub with DHL instructions). Do not know what to do?
