Yes, that is our best option. We called a few days ago and were told that our case has not yet completed 6 months and asked us to wait - we will call on Feb 5th. Hopefully it will be done by then.

Only if you need to update your SS card if it still says "Not authorized for employment" or something to that effect. But that has nothing to do with ROC approval as should've been something to be done at conditional GC approval. Mine still needs to be updated.

No news is good news but it's frustrating not knowing what's happening. Start worrying if you haven't heard back after a year but otherwise just wait until the required wait period is up and then call.

yea I guess we are in the same situation, I don't know if i'm supposed to be worried or not and I don't know if calling them will make it better or worst for me.

I am a september 2013 waiver filer . I have been waiting for 4 months without a RFE or an interview notice. I think I have solid evidence too. But would you mind sharing the kind of evidence you sent ? Would give me a sense of relief. Thanks in advance.

Hi satson5541,

If you have very solid evidence, you have nothing to worry about. Here are my observations about the whole ROC process: ( I could be wrong, but this is what I noticed.)

1. It seems like USCIS processes the straightforward cases first, i. e. people who filed jointly with their spouses and are still in bona fide marriages.

2. Then, they look at cases that have waivers, i. e. divorce etc, which are much less in numbers compared to straightforward cases.

3. Cases with waivers that have strong evidences of bona fide marriages are then adjudicated and approved.

4. Cases with weak evidences are then adjudicated and the adjudicating USCIS officer decides to send an RFE.

5. Then, If the RFE submitted by applicant is strong enough to remove the doubt about a bona fide marriage, the case is approved.

6. If the RFE does not provide sufficient evidence, then an interview is scheduled.

7. At the interview, the USCIS officer will try to clarify everything that is creating the doubt.

8. A case will be denied (which is rare) if the USCIS believes beyond a reasonable doubt that there are evidences of fraud involved.

This may make you feel better:

I actually did not have too much paperwork to show, and I was worried, because my ex-wife and I are not in touch. I did NOT even have a joint bank account together with my ex-wife. And, my ex-wife did not even change her last name.

Because my marriage was in good faith, I procrastinated, and thought that we have our whole life together in order to set up bank accounts, change my wife's last name and do everything else that normal couples do. My sudden divorce came as a shock to me!

Therefore, If you have solid evidence, I believe that you will get the approval, without any RFE and/or Interview.

Another thing I noticed is that USCIS is trying very hard to process the cases within 6 months. Mine took 6 months and 5 days to get the approval.

If it has been 4 months already for you, I believe that if you do not get any RFE in the next 4-6 weeks roughly, your case will be approved.

One thing I could not figure out is that whether USCIS pick cases randomly to interview people in order to assure quality control or just to meet government regulation that requires them to randomly audit cases.

My apology for the late reply. Your post was helpful and calming. I have sent everything I could to USCIS. At this stage if they need something I would prefer an interview so that I can talk eye to eye with the officer rather than letting some document do the talking.

I just called USCIS, it looks like the case processing time restarted from zero the day it was transferred to CSC, we'll have to wait till May 15th to call them back, unless and hopefully we are approved by then.
