sheva29, would you please post the exact text of the USCIS letter you received?

This is what they sent me the following:

"This letter is in reference to your Form I - 751. Petition to Remove the Conditions on Residence. This is to notify you that your petition has been relocated to the USCIS Field Office listed below for adjunction. That office will schedule an interview for you. When an interview date becomes available, that office will notify you in a separate notice of the date and time you will need to appear for the interview.

When you appear for the interview, you must bring this notice and your appointment notice, along with evidence to establish that the marriage through which you gain your conditional residence status was entered into good faith"

I never received a ROE or something. Like many people who Filed in July, my case sent from Vermont to California and from California they replied that.

That's the RFE on steroids. Not only are they demanding additional evidence, they want to quiz both of you separately to see if they can find any inconsistencies. Assemble every possible bit of evidence between now and whatever your interview date turns out to be. They will ask lots of questions to see if you two really live together ("What kind of toothpaste does your spouse use?", etc.). Be VERY well prepared, and try to remember all the questions you are asked so you can quickly post them to VJ afterward.

How did you arrive at these conclusions (especially that they want to quiz both of them separately ?) ? This seems to be standard interview notice and there is certain percentage of I-751s that do get called for interview just because - there may be nothing suspicious about it although they definitely need to come prepared with supporting docs.

Again - what makes you think it is going to be Stokes ? People do get interviewed for their ROC routinely and it has nothing to do with Stokes.

Just now, I received this sms/email message:

On December 2, 2013, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

I'm so happy I didn't get RFE.......hopefully will get the card before Christmas.....yaaayyyyyy!!!!

Well, I have no doubt he/she is a great and helpful person, but hardly ever first interview is Stokes one. He/she seems to be completely missing the fact that I-751 interviews are routine part of the process. Stokes in one step before denial and is trigger by serious fraud suspicions. Maybe you like to be told you're fraudster by "knowledgeable" stranger on forum, but I bet most people don't...

The above is a reasonably accurate summation of the process. During our time at this stage, an immigration attorney told me that, by statute, a certain number of ROC couples are to be interviewed (10% was the figure, I believe). He said -- and anecdotal VJ reports have said, over the years -- that the questions asked are more perfunctory than based on suspicion.

The letter (quoted above) from USCIS, if read accurately and interpreted literally, sounds like a standard transfer notice and call for an interview, rather than an RFE on steroids or anything specifically worrisome.

Of course, nothing can be taken for granted during the immigration process. The couple should come prepared with full copies of their submitted I-751 package, originals of official documents (marriage & divorce certificates, for example), and other newer evidence that would help to convince a third party of the financial legitimacy of their marriage. In contrast, the couple should not be paralyzed by fear at this point, because there's no imminent need to suspect a Stokes interview if their case is otherwise typical.

Excellent documents that are often overlooked as evidence are Wills, medical powers of attorney, and HIPAA releases. (Immigration aside, it's important to have these things in real life.) The interviewee has ample time to pursue and procure these documents.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I think this is the right thing to do right now. I will most definitely have more information when the notice from the local office comes. This wasn't actually the regular format letter that comes from Vermont. The format was totally different and the information could just be interpret as it is.

These couples have seemingly real marriages and yet have been dragged though and ground up by the New York USCIS system, facing years of struggle (including multiple court battles) and tens of thousands of dollars in costs.

The evidence seems quite clear that actual innocence is no defense against being wrongfully denied.

I suggest being very fully prepared for a Stokes interview, rather than letting your case potentially develop into another such tragedy.
