First of all, hi everyone.

My situation is kind of messing up. I married a usc for almost 3 years now. While we been together she cheated on me once and pregnant with another man. but because we are still love each other so we decide to stay together. During that time I got my 2 yrs green card , she gave birth a girl. We decided to put the mans name as the father of the girl. now the girl live with her dad not us. When the time came for I 751 , I filed it without putting girls name in the form coz she's not mine. Then I got RFE, I responded, then I got a letter saying to wait for an interview.

What should i do in this case?

Should I tell the truth or pretend like nothing happened untill they ask?

Should I divorce?

Can you help me please?

Look at your life from the outside , You claim a valid relationship, your spouses in the mean time is having sex and a child with someone else ( I would never believe the one time only bit as an immigration officer ) and that man is raising the child. Did your wife at least give the child up or is she involved with the father's raising the child.


This will not be over quickly. You will not enjoy this.

You're asking a bunch of strangers on an online immigration forum whether you should divorce your wife or not?

My advice: You should not ask a bunch of strangers what to do with your life.

Umm silly question, but you ask " Should I tell the truth or pretend like nothing happened" You have the paternal fathers name on the child's certificate of birth??? I am going to take a long shot guess here and say this is why they have asked you in for an interview!

Also you state "she cheated on me once and pregnant with another man"???? That means she has cheated you twice!!! As I read it anyway!

I can not see how you can pretend that nothing has happened, USCIS are trained to tell if people are lieing.

In essence my friend! Tell them the truth, the whole truth and nothing but the truth!!!

If it was me in that position and lucky for me I am not, I would divorce her, sell up, surrender my GC and go home!

Why it seem that I have no other choice but giving up the gc? Even I still live with my wife. She made mistake but she has changed thats why we r still together. Why wouldnt the officer listen to this? I think you guys have seen rhis a lot on tv or real life. People r together but they cheat and then they change. Why I cant forgive what she did to me? I love her and she loves me thats why we r still together.

we still live together but it is not working out at all, I'm going to divorce her when we'll do the DNA tests.

The problem is that you are asking if you should divorce her to us and it makes it sound like you just stayed with her for the greencard. Either you love her and want to work through it or you don't.

They are going to think the situation is a little suspicious. You'll just have to go to the interview, be honest, and then see what becomes of it.

I read your case its almost the same as me.But mine is kind of hard for me now. During the tine her pregnancy, we think about our relationship and all. We finally made decicsion to stay together coz we know we still love each others. thats why we think that it shouldnt be a problem. Butnow we are not sure. We dont know what the officer will think about our case.

Its not like i want to get green card. The reason I want to divorce is I can earn status to live in usa and be with her. i try to choose which way will be the best chance for me to stay with her.

Oh dear. Tell the truth to USCIS. They have ways to find out things if you try to hide it from them or if you lie.

Assuming this is not a troll this case reeks of fraud.

First, paternity testing kits are very cheap. Get one and find out who is the father. Contraception is not infallible.

Second, your wife is looking after her child, but not living with the child? It is hard to believe a mother would leave her child, and appears very odd. Are you being truthful about the living circumstances?

Third, you should have declared the child. Legally you are just as responsible as the mother for the child's well being while married. "MARRIAGE" is more than about love, it is a legal term used by the state to think of you as a single unit. Even if you got divorced you MAY be expected to provide for your ex-wife and your child. The law is complicated in this area and a lot depends on your state.

Remember that you have to prove to a human being that your relationship is real. Tell you what, we're human, and some of us think your relationship is not real. Sorry if you feel that way, but that's the way it looks. You can sugar-coat it all you want, it still looks fake. Pray that you get a very understanding interviewer and that the outcome is favorable. Looks like a long shot, though.

You do have choices, but as said earlier, you are asking strangers to make your mind up for you! What do you want is what you should be asking yourself?

Harsh reality check here and not meant to be mean, but this is serious, has she changed or has she realized that she may be seen in a bad light and accused of immigration fraud? That is a question and the answer will be left to USCIS I/O and yes he will listen to all that you both have to say on this!

This my friend is down to you, it is easier to forgive than to forget! Next time you are home alone and she is out with friends or working, will it not cross your mind as to where she is and more importantly, what she is doing?

I will assume this is not a troll post also; You know what I would do as I have said already, but to enlighten you further and please bare with me, but you have given up your life in your home country for a woman who has admitted to cheating on you, fall pregnant, may be yours, may not, but a DNA test will verify this, you are now financially obligated to a child that is not living with you, but with someone else, she has a previous marriage to a CR-1 beneficiary who we can only assume is still under the I-864 conditions...In other words, your wife has to support him until such time they become a citizen or 10 years has lapsed!!! Not only that, but you have a dependent child whether you like it or not and someone has to help with raising of the poor child!

I would see choices here and know exactly what I would do!!!

I have so many concerns over your post and feel that so will USCIS, I would seek legal advise on this and not ask in a publc forum such as this..
