So I'm thinking my options:

appealing, but it looks like this case might not be appealable?

Moving to a 3rd party country, marry, stay there for a while and file marriage visa

Or... ? Other ideas

Nothing to appeal. Appeals would be very long and costly. You can't appeal anything if they want to see a visit with family that didn't happen. You can't appeal more face time together. K1's at CSC that are returned will be allowed to expire and as I said before NOT reaffirmed. Been there done that.

A lawyer is a waste of money. Use that money to visit and spend time with him/family and make your case stronger.

Many third countries will require a residence permit of him, again be careful which country you chose. Take your time researching what is required and ask people who went through the same scenario. Wedding planners have a good grip on what is needed.

We tried that route and though we were told by the third country's officals it would only take about 7 days to get the marriage application approved so we could marry, they changed their mind and said it can take 3 months or more when I got there and I had to leave and couldn't stay longer so there was no wedding after dragging all my wedding stuff there. Talk about Bridezilla !

They also wanted to see original documents which they didn't tell us about nor did they list them on their web site. It can get very messy with marriage requirements between foreigners in a third country.

Research, research,research and then research again and call them on the phone and verify what you read or hear. We did all that and still the ding dongs messed it up. It was a very backwards mentality and at their own pace kind of situation that defied all logic.

I insisted they tell me where our marriage application is and drove all over the place and finally found it under a tall stack

of files and they refused to accommodate us during my stay there. This included bitching at the Minister of the Interior.

It was a no go.

Is there some reason visiting India is off the table? Obviously he currently has some sort of residency/long-ish term status there [otherwise he would not have been able to interview there]. Truth be told, I don't think any CO would ding you for not hanging out in Iraq given the safety issues there. But, you already have a relatively safe 3rd country option in India. [Look, I get he may not like it there for numerous reasons, it isn't everyone's cup of chai, but it is considered a somewhat typical place to visit with a decent and well known tourist industry - the more convoluted you make certain aspects of this journey, the harder the sell to the CO - you want this to be straightforward and logical as possible].

If you really need another option, Dubai/UAE areas seem to be easier for visas/visits for some people in that area....

Wait until you get your denied letter first. You can appeal call your senator for help.

India is out of the q. He graduated last month and his student visa expires at the end of the month, he will be going back home, and I won't be going there as we both agreed for safety reasons. He had an idea to work in one of the gulf countries so he is not sitting around idle. We would meet / and or marry there and reapply for CR1. That was one idea

Skyping with family ( cam screen shots also) and phone loge with family will help as well as email communication.

Affidavits of friends and family from both sides attesting to your genuine relationship will help.

There is nothing to appeal. They don't have to wait 6-9 months until she gets a denial letter.

Well boarding passes are a great idea but are not absolutely necessary if you don't have them because people can lose those. They won't expect you to travel all the way to see each other again just to obtain them. But if you have any primary evidence such as receipts, boarding passes, credit card bills etc. that put you and him in the same geographical location then collect all of those and send them to him. Also, another thing would be to show evidence of recent correspondence since you received the petition approval. You might also want to both write a new and updated letter of intent with it clearly dated and signed by both of you to indicate you are both still in a relationship and both still intend on marrying since the petition approval.

In fairness they are very important and I would say very necessary! Especially for the fiance process as it is evidence that a person may have used it to board a particular flight to arrive at said destination to meet the other, that on its own may not be solid proof, but backed up with an invoice and photos it holds weight.

Without the boarding pass and photos, how else can it be determined that a couple have met? Given the powers of technology and computers these days! I am not saying for one minute that anything anyone has submitted is or has been tampered with!

I have always said and will remain in the corner by saying throw anything and everything at them even if you think its weak, but it may be the one piece of evidence/information that ties it all up.

Bare in mind that USCIS can check to see the point of entry details of past visits if dates are given to be verified

I really dont see why not meeting in India would be a problem.

I would NEVER go to India, the thought scares me more than Iraq honestly. The rape epidemic, the number of diseases, the poverty that would depress me, the constant harassing in the street of foreigners, definitely no-no.

He is a student in India, so I am guessing his family is not there with him.

I would rather have a friend with me when meeting someone met over the internet for the first time too, actually I did, when Mr. Peter_Pan came to see me, we took a friend of mine on our first trip.

Many thanks again for all your help aNd support and kind words. After viewing your thoughts, We discussed what our ideal scenarios would be for the 2nd try and they were pretty close to the same thing / wish using CR1 with more time and visits, and documented family support. We will try to research more and check up on examples from others experiences & regional forums. So we can be ahead of the game this time.
