Good day everyone I would just like to ask if let's say we are just a few hundred dollars short in meeting the poverty guidelines for k1 visa...can money from savings account be added to the income?

Assets (liquid assets at least, such as money in savings accounts) can be used, but you will need to make up five times the difference, e.g. if you are short by $1,000 then you must demonstrate $5,000 in assets.

for a spouse it is 3 times assets not 5

see the 864 for clarification

Sorry if this sounds like a stupid question but I just really need to know :( ......so I could have atleast a peace of mind and not gonna have a heart attack thinking about it while waiting for our interview date:'(

Give or take, you'll need at least $2500 if you're only $500 shy away from meeting the poverty guideline. I think you'll need a letter from the bank as to show when that account was opened and show that it was not a huge amount of money was recently deposited into the account.

If you are only $500 dollars per year short then 5 times that is $2,500. With $15,000 in the bank things should be fine. The embassy may look at that joint account (if that is where the bulk of the money is) with his parents with a few questions on their minds... such as the money is not his but his parents. The embassy frowns on things that don't look "quite right", so they may look closely at when the money was deposited in the account and if its all in a joint account, they may not consider that money at all. Lots of "MAY" and "IF" there...

I would suggest that maybe the parents become co-sponsors, take the worry about being close. And if you go this route I would suggest both your fiancé and his parents completing the I-864 along with the I-134 (and supporting documents of course)

If you are retired and not working and your collecting SS and you have stock/retirement investments, what are the guidelines that they will use? Is there information about this where I can read more? Do you know of anyone who has been in this same situation and what where their details as to what was asked at the interview. Where they approved?

I also have heard from some that when the sponsor is at the interview they look positively on the application? What have you heard?

But he has his own savings account With quite a bit amount of cash..prolly around 10k...we just found out about the joint account of him and his mom recently...it was opened years ago when he was I believe in highschool......we just decided to include it as a backp support of his income plus his own savings.....

Then that should be just fine, $10K more than covers the shortage.

I would suggest bring in a years worth of bank statements (12) for that account with the $10k in it ... I know that is a bit much but that would ease the COs questioning. Just my opinion.

And just a follow up question...

Computation of annual income is

Hourly rate x number of hours in a week x 52 right?

Just figured out today...why would they (people helping us From a visa agency) tell us we are short if my f is earning 10.50/hour and working 37.5 hours a week x 52 weeks in a year???

If that computation/formula is right then we arent really short from meeting the poverty guidelines after all? Coz he's making $20475 (income alone) I know its like a no brainer issue but I am jst sooooo confused...

Retired or working doesn't matter, the guidelines are the same. You must meet or exceed 125% of the Poverty Guidelines, these numbers are listed on the I-864P. http://www.uscis.gov/files/form/i-864p.pdf

Now if you are not working, collecting SS income (which is not taxable unless certain limits are exceeded) you should get a benefits evidence letter, you can get this from MY SOCIAL SECURITY, simply log onto your account and it can be created from there and printed.

Between your SS income and your investments income you still need to show yearly income that meets OR exceeds the guidelines listed in the I-864P.

Now for me (yes I am retired) I have SS income plus a few others that are not taxable so I do not complete a tax return. Yes my wife (then fiancée) was approved without me presenting a tax return. You need to complete the worksheet in the 915 pamphlet this will show whether your income is taxable or not. (you will need to do this again with AOS as they want proof you income is not taxable).

Bring copies of the benefits evidence letters, statements from your investment accounts, bank statements and other account statements showing assets. If you exceed the requirements you will be fine.

Oh, if the petitioner can be there for the interview for sure go... its a great experience! Necessary? No.

If tax returns, W-2 and pay stubs show income that meets or exceeds the 125% of I-864P poverty guidelines, there is no confusion. If its a new job, get a letter from the employer verifying income.

hey hank.. I am unable to find this requirement.. where did you get it? I checked the 134 instructions, but don't see it there, I was under the impression it would follow the 864
