His marriage in the Phi to first wife is not valid any longer and would be listed as divorce. If he divorced her (first wife) then she would be considered "divorced" and she can remarry. She cannot be the one who initiated the divorce, but he has to. This is very important distinction. If she initiates the divorce then she is not eligible to remarry in the Phil. She can remarry in the States because she is technically divorced for all intense and purposes in the USA. She just needs to file the approved divorce decree with Phil Embassy/DFO if she plans to remarry again and only if he initiated the divorce.

He can remarry because he is leagally divorced. His second marriage is valid in the USA and Phil as long as the second wife is "not" married to anyone else prior to her marriage with him. If they want this to be recognized by the Philippine Government then they will need to file with any Phil embassy or when an outreach comes to their community.

More information is available here: http://www.philippineconsulatela.org/FAQs/FAQS-legal.htm#4

The form they would use is Form FSC 75-94 Rev. 3/2013.

I hope this helps.
