I got RFE .... :( any help?

I got a letter requesting more evidence.

It says I did not provide enough evidence that covers the two years. I though I did.

The only thing I did not include is lots of bank statements. I have them though.

Could you please let me know your opinion.

I got a pretty standard RFE. It does say that I need to provide more evidence for 2011, 2012 and 2013. and provide taxes for 2012

Here is the items I sent back in Feb:

1. Previous address.

2. Copy of green card

3. Copy of Marriage Certificate

4. Copy of Wedding announcement published in local newspaper

5. Rental agreement for us. Effective from August 2012 to July 2013.

6. Driver’s licenses showing same address.

7. Tax Transcript 2011

8. Tax Return 2010

9. Wife’s paycheck stub showing she is married (Dec 2012).

10. Wife's Company 401(K) enrollment form showing husband as the primary beneficiary.

11. My paycheck stub showing married status (October 2012).

12. Gas and Electricity bills showing both names. Only one month.

13. Progressive car insurance card for us. Effective from October 2012 to April 2013.

14. Progressive- car insurance letter showing we have been insured since 2010.

15. Family Health Insurance card for us. Issued July 2011.

16. Dental insurance card for us.

17. My employer confirmation letter for 2013 showing:

a. Family Health and Dental insurance for us

b. Life insurance for me showing wife as beneficiary.

18. Wal-Mart Credit Cards and Statement for January 2013.

19. Wells Fargo Joint Bank Account statement for February 2012.

20. Wells Fargo Joint Bank Account statement for October 2012.

21. Copy of voided check showing both names.

22. Gym membership contract (Jan 2013 to Dec 2013) for us

23. New Year’s celebration in with Family (12/31/2012). Copy of picture.

24. Copy of flight tickets to Texas (June 2011).

25. Copy of flight tickets and itinerary to Mexico (November 2011).

26. Picture of us in Mexico (November 2011).

27. Copy of electronic flight tickets to Mexico (May 2012)..

28 Affidavit letter from a family friend and mother in law

This is all good, but instead of just one month, as I see you did for most of them, show ALL of them for the past two years. Every month. Then you should be good.

All you need to do is comply with the RFE. That can be done by simply sending tax transcripts for any year they asked for. You already sent one so I assume you know how to do it.

Bank info isn't part of the RFE it seems but if you want to send something all you need to do is send a few recent statement copies. Old ones dont help because they money can be moved. If they didn't ask I would send it.

We didn't submit anything close to this laundry list of info you sent and we has no problems so you have covered everything already. Looks like they just want tax info.

You provided all that evidence and they still want more!?

I honestly do not have a clue why you got a RFE. How bizarre.

Maybe send in the 2012 tax transcript?

We submitted a lot of evidence and still got an RFE too. I think they just pick some cases at random to provide RFE.

We responded with more bank statements ( span of 2 years of. Marriage on 3 different CC.), so just send them a bunch of statements for join CC.

Also, we submitted bank statements spanning two years as well.

If you have any new loans, like we did, we submitted that as well. Anything that shows you share a life together. Especially commingling of finances.

Health insurances in both names, power of attorneys, life insurance, etc...all that is solid evidence of a bona file marriage.

All you sent before was goo, just make sure they see you have been living together as a couple for a couple years ans still re together.

Taxes are a strong piece of evidence if you file together as well.

Do not worry, RFE are common, and I have seen a lot of RFE's being issued lately. You will be fine.

Well, it says that they need evidence that "covers two years". It sounds like you sent lots of evidence but much of it didn't cover the period they needed?

Maybe in addition to the taxes from 2012, can you send them your rental agreement(s) before last August, as well as your bank statements and bills covering that period, if you have them? Better too much info than not enough.

Filing to POE: 8 months, 1 day

Filed AoS application: April 5th, 2014

Received NOA1 in mail: April 11th, 2014 (no text/email)

Received NOA2 in mail: September 2nd, 2014 (still no text/email)

Separated: September 2015

Yes I noticed they asked you for some info they have already. They want the latest tax info to prove your recent income and that you have paid any taxes on that income.

Since you know how to get the transcripts I suggest you just comply asap. We just got our transcripts for a different purpose. It ont took a few days to get them by mail. You can have them faxed.

You don't need more pics ect. Just comply with the RFE letter.
