I'm filling out the paperwork for my SSN card and question #3 is about citizenship. I have the following choices:

U.S. Citizen

Legal Alien Allowed To Work

Legal Alien Not Allowed To Work

Other

I have a K1 visa and I know that I'm not allowed to work until I get my Green Card (or EAD if I choose to go that route), however (if I choose Not allowed to work) it says that I need proper documentation.

If you check "Legal Alien Not Allowed to Work," you must provide a document from the U.S. Federal, State, or local government agency that explains why you need a Social Security number and tha you meet all of the requirements for the U.S. government benefit. NOTE: Not all U.S. State or local benefits are acceptable for non-work SSN purposes. Contact SSA to see if your reason qualifies.

If you check "Other," you must provide a document from the U.S. governmen agency that explains why you need a Social Security number and that you meet all of the requirements for a Federal benefit except for the number.

Please, fellow K1-ers, help me out with this one. I don't want to choose the wrong one/have the wrong paperwork to back it up. I printed the EM-00154 Evidence of Employment Authorization for K-1 and RM 0023.500 Employment Authorization for Nonimmigrants.

Hi

You apply for legal alien not allowed to work. Just take your marriage certificate so they put your married name on it. Also your passport so they see the k1 visa.

As a K-1 visa holder you are able to work for the 90 days your visa is issued for. When my fiance got his Social Security number he had his I-94 stamped at JFK for work authorization, but from what I understand from the guides, it's not necessary to have to work. But I would do more research and ask more about it.

August 21, 2006 - Medical

August 30, 2006 - Rec'd packet 4

October 2, 2006 - INTERVIEW!!! APPROVED!!!

October 4, 2006 - Visa in hand!!!

October 7, 2006 - POE at JFK and got EAD stamp!

October 21, 2006 - Received Social Security card

October 28, 2006 - Married!!!!!!

AOS/EAD

November 10, 2006 - Sent off AOS/EAD

November 16, 2006 - NOA1 for AOS and EAD

December 2, 2006 - Biometrics for AOS and EAD

January 23, 2007 - Without any touches, we get letter for interview in March

January 26, 2007 - EAD card production ordered

January 29, 2007 - EAD touch - Approval Notice Sent

February 1, 2007 -received EAD card

February 8, 2007 - AOS touch

March 6, 2007 - AOS Interview - approved pending FBI checks

May 25, 2007 & May 29, 2007 - AOS touch- yay! it's been awhile

May 30, 2007 - email notice Welcoming New Permanent Resident

June 6, 2007 - Greencard in hand

REMOVING CONDITIONS

March 15, 2009 - Sent off I-751

April 10, 2009 - Biometrics

May 18, 2009 - APPROVAL LETTER RECEIVED!!! Without any online updates

As a K-1 visa holder, you are NOT automatically allowed to work for the "90 days your visa is issued for". You have to get the temp EAD stamp from the POE to be eligible for this and not all POEs issue this. Kath gave you good advice. You are not eligible to work until you get EAD of some form. That would be the correct answer to this. After you go through AOS you will be authorized for work then. At that time, you take your AOS paperwork to SSN office and they will amend your status and issue you a new card.

Yodrak is 100% correct. My husband arrived on a Fiance Visa. He obtained his SS card prior to us even marrying within the 90 days. His SS card did not mention anything concerning work elgibility. The difference compared to others is that he arrived on a K-1 Fiance' visa. Therefore, you should check the box that says "Legal Alien Allowed to Work".

I went to the office today and I had checked "Not allowed to work" because that's what seemed to make the most sense at the time. The guy who processed my paperwork didn't say anything and didn't give me a hard time. Apparently there's going to be a delay because the Customs officer who entered my paperwork at the POE entered my name wrong. :rolleyes: I'm starting to think the officer who entered my stuff didn't know what she was doing because this is the second thing we've found out was wrong in my paperwork processing. :bonk: I just hope they are able to sort things out so that I can get my SS card and on with my AOS paperwork.
