Gay couple may be 1st to win green-card petition

FORT LAUDERDALE, Fla. -- A Bulgarian graduate student and his American husband are the first gay couple in the nation to have their green card petition approved after the Supreme Court ruling on same-sex marriages, their lawyer says.

But Traian Popov, here on a student visa, won't be able to work or visit family back home for at least six months while his green card is processed. His marriage to Julian Marsh, performed in New York, still won't be recognized in Florida, where they live.

The U.S. Department of Homeland Security couldn't immediately confirm Monday whether this case was the first. But the couple's lawyer, Lavi Soloway of The DOMA Project, says his organization has filed about 100 petitions for same-sex couples since 2010 and expects more approvals in the next few days.

wow now that couple must have some connections. I feel bad for the people on here waiting on their loved ones. They moved all the illegals ahead of them, now it appears they will bump the gays to the head of the list

There are several cases in this forum, of beneficiaries who are in the US with student visas, get married and get started with AOS.

The only connection they need is that of marriage, and that one they do possess, according to the article.

Thank you for stating that water is wet. I am referring to the fact that thier case was approved in a few days

Even if that were true, would it not call for congratulations?

Ok congrats.. I am all for Gay rights. Fully support it and applauded SCOTUS.

I don't see how the case could have been "pending" because up until now it would have been not approved. It's obvious that it was hand picked and approved to make a point.

My point is that a lot of people here have been waiting a long time, who have done things the right way .

I think your statement answers itself.

It was pending because it could not be approved.

Isn't that how the law was supposed to be applied? I would venture to say that had their case been approved prior to the SCOTUS ruling, it would have given reason for a lot of complaints.

I don't see how the case could have been "pending" because up until now it would have been not approved. It's obvious that it was hand picked and approved to make a point.

My point is that a lot of people here have been waiting a long time, who have done things the right way .

You don't see... but it is there to be seen. Many gay couples have put in petitions knowing they will be denied... but, with a legal team, they have appealed the denial and kept their cases active by going through the lengthy appeals process. You know, court cases, legal arguments, Objection!... The foreign partner of the couple mentioned in the OP is here LEGALLY on a student visa and has done everything the "right way." Just because you don't get it doesn't mean it can't be understood...

What will jump in front of you next? An excited puppy? A ball rolling into the street? A dandelion spore? What is next!?!?!

Isn't that how the law was supposed to be applied? I would venture to say that had their case been approved prior to the SCOTUS ruling, it would have given reason for a lot of complaints.

How could it be pending if it was rejected. If applied for my buddy from the PI to come here it would be rejected. Not pending because it would have no merit under law.

I really don't care enough about any of this to keep beating it around. I have a GZ/TM trial to report on.

Yes, chances are their case was pending through appeals. There are several couples in the same situation, waiting for the SCOTUS ruling on DOMA.

I read your response that I responded to - nothing more. In that response, you seemed to falsely be under the impression that a same sex couple has gotten approved in just days. That's not what happened.

The petition was approved? #######?

OK - that means the lawyer is stupid - and only filed the I-130 without the I-485.

Usually folk that 'want it faster' file both, concurrently.

We've a guide for that, as well ;)
