Hello all VJers,

We got our NOA2 June, 17, 2013....and I was under the impression all K-1 are sent to NVC and then sent to the Consulate of designated country (Nigeria for us)....well I called NVC to see if they received our file and the guy said no then asked what our letter said and I told him it states that is was sent to the designated consulate and to contact the consulate for any questions....which my fiance is doing today.....Could anyone tell me why NVC was skipped ??? Is this a good thing???? I have had such bad luck as of lately so maybe Im just worrying for nothing....any input would be great....Thank you

No one ever skips NVC K1's go there to get a country specific number and to be placed in their pouch to go to their country. Once it gets there it only stays for a few days however it can take over a month to get there. California tends to send them in batches.

This will not be over quickly. You will not enjoy this.

I've seen some post about the same thing and they get to the embassy and then they are approved, so I believe sometimes USCIS send some petitions directly to the embassy but I am not sure why they skip NVC...

Thank you that is what I told the guy at NVC this morning and he argued and argued with me that it was not going to NVC....but to Nigeria right off. I told him I thought the file had to get another number designated for the individual country and he said usually that is the case but since my letter doesnt state it is going to NVC then it wouldnt. Did anyones NOA2 say it was going to NVC ????

I have never heard of a NOA2 saying it was going to NVC they always say they are being forward to the consulate listed and I have never heard of one NOT going through NVC even the thread that was linked here says they all go to NVC ( guess the poster can't read ) NVC is the keeper of the country specific number so it MUST go there . It only stays for days once it arrives. It should arrive in 1 to 8 weeks

This is a common misconception. ALL approved petitions are transferred from the Department of Homeland Security's USCIS to the Department of State's NVC.

Please refer to the Department of State Nonimmigrant K-1 Fiance(e) Visa FAQs for correct information:

http://travel.state.gov/visa/immigrants/types/types_2994.html

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

All approved petition go through NVC because they alone have the power to issue a case number and authorise the release of the petition to the respective embassy.

NVC does NOT issue the embassy case numbers, the case numbers are issued by each respective embassy and that number is sent to NVC.

NVC DOES issue the Embassy case number because I for one received my case number on the letter NVC sent to me to tell me they were forwarding the petition on to my embassy in Dublin. So without a doubt they are the ones who issue the case number.

No NVC does not issue the case number. You got the letter from NVC with the case number (true, as does everyone else) AFTER the embassy issued the number, notified NVC of the case #.... then you were notified.

No, that could not be the case because NVC sends you the letter with the number BEFORE they forward any details whatsoever to the embassy, as it clearly states in the letter. It would not make sense the embassy sending them a code if they haven't even any information of your case until NVC forwards it to them. The unique three letter code is used by NVC to generate a case number associated with the embassy closest to the foreign applicant. If it was the case that the embassy generated it then there would be no need for the three letter embassy code for each embassy because it would have no function. I hope someone else comes here and indicates to you the obvious. :)

Fine for you.... NVC controls ALL the embassy case numbers for every embassy in the world, even for those individuals that are doing Direct Consult Filing, the embassy has no clue what case numbers they are going to assign for those UNTIL they contact NVC..... "duh"

Now for reality; NVC electronically transfers ALL files to the respective embassy where the case number is assigned, when NVC is notified of this number (by the embassy) they physically attach this number to the proper file, then the file is physically sent to the embassy.

And yes an embassy code is needed, and it does have a function, but NVC doesn't assign it.

BTW - this information came from NVC, not an opinion.

For the record, NVC doesn't seem to have any knowledge of DCF cases and is unable to access them at least from a basic standpoint. We had an issue in which we already had an approved visa and a STK number and another STK number was generated by the NVC when they received the first approved I-130. When I contacted them about the issue they could not see anything relating to the first case at all.

I just off the phone with CSC where the file originated, by the way they are telling it is......I called asked if they knew where my case was and what NVC had told me... the guy on the other end who was a tier 2 from CSC said I should call the embassy in Nigeria ...He said generally all files are sent to NVC but since it is not stated like that in NOA2 that maybe the immigration is starting something new and sending them directly.....He was unsure of everything and told me he couldnt tell if my file was sent or not anywhere. ...So I will call the Embassy tomorrow to see what there answer is to late in the day to do it now.....Thank you all for your input it really has been a help
