Minimum Income Requirements

Hey there,

Have searched this question on the forum and have got rather mixed/confusing answers, so thought I would ask again.

We are applying for the K-1 visa. My fiancee (USC) is self employed. We have no dependents. He lives in mainland America.

Am I right in thinking he needs to complete the I-134 Affidavit of support (because I was confused with people mentioning the I-864?)

And what are the minimum requirements for his income? And is it total income, income after tax etc?

You use the I-134 for the K-1 and the I-864 after you marry for filing AOS.

Most consulates want 125% even with the I-134 because you will need 125% for the I-864 only a short time later. The instructions for the I-134 say 100% though, and some consulates will accept that. I believe London is one of those.

If he is self-employed, you need line 22(total income) of the most recent 1040 to meet the requirement.

I have heard 125% of poverty level which isnt much. check the guides up at top click on guides

On the guide it says $19,387 if there is 2 dependents. If he is self employed, is it more? ie. $22k?

Having an employer or being self-employed makes no difference. The only ones it is higher for is if you live in Hawaii or Alaska.

Yes, $19,387 for 125% since his household size is 2, himself plus you.
