Hello,

I have got married after the rejection of my fiancee visa due to denial code of "212(a)5(A),9FAM40.1NFA - invalid immigrant visa or fiancee petition." Means they did not believe we had a relationship that was genuine. My thread from that fateful day is here: http://www.visajourn...ition-rejected/

I have almost all of the paperwork for my I-130 ready. How do I revoke the K1 visa petition? Do I wait till the K1 is revoked before I send the I-130? Is there anything I need to check before I revoke the K1 petition? Should I front load the I-130 petition and send some pictures like I did for the I-130 ?

Any and all advise is appreciated.

Regards,

DH

send a letter to the office on the cover of the noa2 cancelling the petition.. list all your info and copy your noa1 .. mail with a return receipt

it will take a month for them to write you back.. I am sure once it is signed for by your courier you can send out the 130

you know better than anyone else what happened with your original filing.. if it was denied for what you stated, of course you are going to frontload it.. aren't you??

I haven't seen this advice given on here before. Not saying it's not valid but that I am not sure.

Since you are doing an entirely difference Visa it cancels out itself. But some just like to play it safe and with a short and sweet coverletter saying to withdraw your petition attach to your I-30. Short and sweet no issues.

You need not have to wait for anything really. many here have had denied K1's and married refiled I-130 and did nothing about the K1 and it was a non-issue.

Congratulations by the way on the marriage.
