I hired a lawyer back in October 2012 to file my paperwork for k1 visa just to make sure everything was done correctly and minimze any chances of getting an RFE,I recieved my NOA1 on October 2012, but guess what??? After nearly 8 months if waiting I checked the uscis website and I had an RFE!!!(6/18/13), Up until today I have yet to see the letter!! I called the people at uscis but they are never of any help, they said if I havent received the letter after 14 days to call back!! Has anybody experienced such delay??? And to make matters worse my lawyer wont return my calls!

do u know where your lawyers office is? Could it just be hes off this weekend maybe he'll be back in work tomorrow?

8 months is a long wait for an RFE for an october filer, was your NOA1 sent to your adress or is it being sent to your lawyers office

[August 8th 2013] Packet 3 sent (before received)

[August 9th 2013] Packet 3 received
[August 13th 2013] Medical

[August 16th 2013] CEAC updates - London logs my medical results

[August 20th 2013] - CEAC update - London logs my packet 3

[August 23rd 2013] I call DoS and they tell me my interview date, (2 weeks since I sent ds-2001)

[August 27th 2013 CEAC update - London dispatches packet 4]

[August 29th 2013] Packet 4 received
[september 24th 2013] Interview -
Refused due to passport and birth certificate condition

[september 26th 2013] Emergency appt at HM Passport Office London - New Passport and Birth Certificate in hand
[september 30th 2013] DX collects passport and birth certificate

[October 3rd] - Docs delivered to Embassy

[October 10th] - London Approves and Issues our Visa!!

[October 16th 2013] 4.00pm - Visa in my hand, 11pm POE -Newark

Sorry to here your problems :( that is why I didn't hire a lawyer... I did my research and my fiancé' and I did everything together over Skype. We gat all the documents together first and then we put the information on the forms. When I first came across this site last year and read the guides, I knew hiring a lawyer or an immigration specialist was a false sense of security...Im glad I didn't waste my money was approved last week. I hope all works out!!!!!!!!!!!! :) Remember a REF is not a Denial just need more proof! I hope you 2 see each other soon!!!!!!!!!!!!!!!!!!!!!!

you have now found one of the main issues when dealing with a lawyer

wait for your rfe and respond quickly to it.. it will have a deadline

nobody here can help you, nor will they be able to help you at uscis

you have to wait for your snail mail and your lawyer

That is really good that you did it yourself. But that does not mean that hiring a lawyer is waste of money. Some people may feel that they need help with their forms to avoid the error. RFE can happen ( with lawyer or without lawyer ). Do not assume anything until you have the letter in your hand. So you can see who made the mistake.

A lawyer simply acts as a filter. People have to supply them the same info needed to fill in the forms anyway. They just make some feel better and if that's the case then its money well spent. As we see here it didn't serve to avoid a problem and the paid lawyer wont even call back. What you paid for is a clerk.

The RFE isn't a terrible sign. It means they are working on the case and that when the info is submitted the case will again move forward. The fact that you don't have it may not be what you think. It was probably sent to the lawyer where it simply hasn't arrived yet. If you get it you can respond or send it to the lawyer but make sure you send the letter back as they request along with the requested info.

You can measure you luck factor after you exceed my timeline of 408 days to visa issue. So far you are about in line with many others as far as time elapsed.

if you have a lawyer then you sign the G-28 all the mail goes to the lawyer- you can try calling the customer service number ask for a tier 2 officer you may get some answer there 1-800-375-5283 then 123 or press change of address to get live person.
