Hello,
We don't know what to do with my girlfriend. She is in USA and I'm in Europe. We want to be together but we don't know how to do that. I need a visa to get there. The problem is that she want to be with me but still she is not ready for marriage.
Is it possible to start K-1 visa process and when I'll get the visa, when I'll get there to change the status of visa?

Also, in 2 months she is coming over in my country to visit me. She will be here 2 months. Can we do something when she'll be here?

Thank you

Topic has been moved from Immigration News forum to the General Immigration forum as OP is looking for information but not necessarily marriage.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

What exactly you want to do ? With K-1 visa, you have to marry within 90 days of entering US and you can't change it to anything else.

There is no visa just to be with the girlfriend in US.

Someone told me that when I'll get there, after 30-40 days of my staying there...I can hire a lawyer and change the status of visa, for example in a tourist or work visa...

I don't know if it's true or not, that's why I'm asking

No, it is not true. Beside, what would be the reason for that rather than just going straight for tourist visa ?

Work visa - make sure you understand what does it take to get work visa - it has lots of requirements, availability is very limited.

K-1 is to get married and for nothing else. There is no girlfriend/boyfriend visa unfortunately.

here is the rub.. yes people do that and yes they are successful, but there are others that are not successful .. what is it they are talking about??

a quote you will hear here time and time again

coming to the united states on a tourist/other visa with the intent to stay (marry and adjust/other) is immigration fraud. if you are found to have committed immigration fraud, you are rewarded with a lifetime ban.

there are no bf/gf visas

you have to choose.. tourist.. staying for however long the cbp puts in your passport or fiancée and marry within 90 days of arrival

Some countries you are required to have a US visa to even visit here, others you do not. DOS site has all that information, if yours does, have to visit a US consulate to get that visa. Sure helps to own property, have a good job, even a family, before they will issue one. They want to be darn sure you have good reason to go back where you came from.

If you get through that, will be issued a I-94 that has a maximum stay date, you have to follow that as well, if you overstay, and do not file a Form I-539, and want to get married, will really have deep troubles.

Mother-in-law wanted to visit us, and we wanted her to visit us as well, with owning property and all that and from Colombia, took her a full year to get her visa. When she did come, original plan was for two weeks, we and she wanted to stay longer, and at our POE that stamped her I-94 on the date of her return trip. So we applied for that I-539, 300 bucks, then another amount like that to reschedule her return trip with the airlines.

Just saying this so you know what to expect from actual experience. She had no intention of staying here like you may have. But would never be able to come back if she did, even for a visit if we didn't follow the law.
