Hi guys,

I am hopefully passing my citizenship test in July, and I wanted to apply for my brother to bring him to usa. I have 2 questions, and if someone would help please:

1. I know about new siblings rules and I also heard that I can apply 18 more months one the law is enactment? Now I was wondering if I apply in July how long it will take for my brother to come here? Is it also will take about 1o years?

2. If I file for my brother in July and process last several years, will he able to come on new V visa - for 60 days just to visit while in process?

I hope you understand what I meant, please help if you can..

1. It currently takes 12 years for someone from your country. It's likely to be longer rather than shorter by the type you petititon him, as everyone files trying to get in before the law changes.

2. If you mean the visa waiver program, yes, he can continue to use that.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I was thinking about this: "eligible categories of relatives - siblings would be granted non-immigrant visas and permitted to visit the United States temporarily for 60 days, every year".

So while in process will he be able to come to visit? .. I guess yes..right smile.png Also I heard will be faster now as they will clear all approved and pending application for F4..

I just wanna make sure that he will be able to visit in this period because I have 2 small kids, and wil not be able to travel as much..sad.png( But hope for best...

There is no new rule. The proposed new immigration law may never pass if the republicans in the House blocks it. Also, if it passes - it will pass in a different form after negotiations with the house.

So, it's impossible to know the "new" rules.

Under current laws, it will take 12 years for a US citizen to petition a sibling.

The V visa requires an I-130 filed before 2000. It's impossible for your family to meet this requirement. http://travel.state.gov/visa/immigrants/types/types_1493.html

If your brother wants to visit the US, he will need to apply for a visitor visa and qualify based in his ciecumstances.

o Ineligible to earn points for merit-based visa while in this status.

I am not sure did you understand, but if this law passes it will be new rules considering siblings cause they will cut F4 so they will be able to come and visit for 60 days each yea r which makes sense to me. If I am USA citizen and my brother wants to visit me, then why he needs tourist visa???? He is not coming as tourist, he is staying in my house and visitng his family... I just was wondering is he is going to be able to visit me while in the process of getting here as immigrant because I will be applying for him in July, but then if that process last for years, I would be really upset that he can't come and visit me in years... I know this is all new to all of us, and we don't know still what is going to be, but if someone do understand better then me, or if I am wrong please let me know what you know :))

This law will NOT pass, as it is currently written. That's what Aaron was trying to explain.

What you've been reading is a summary of the bill that passed the Senate. The House of Representatives intends to toss that bill in the trash without even reading it. Instead of one all-encompassing bill, the House intends to pass a series of bills, one for each aspect of immigration law they want to change. In all likelihood, Harry Reid won't allow any of the bills produced by the House to even come up for a vote in the Senate. Most House Replicans are strongly opposed to any bill that includes amnesty for illegal immigrants. All Senate Democrats are adamant that there will be no immigration bill that doesn't include amnesty.

In other words, there's a good chance that nothing is going to change.

They can avoid the immigration bill but they cannot ignore the fact that there are 11 million undocumented inside US..

They have been doing a pretty good job so far.
