help for i751 waiver

Hi, I am filling i751 waiver good faith. would like to know if need to include evidence from before marriage as well? do I need to write explanation of marriage and why separated or is it irrelevant and only need to show good faith? (e: how we entered the marriage) thanks

Many people include evidence from earlier because that is when the relationship was the healthiest and it helps support that you believed that you were in love and had found your lifepartner

This will not be over quickly. You will not enjoy this.

Sometimes couples take pictures even when times are bad, use those, I refuse to believe any marriage even though it may be an unhealthy union, everyday is not bad. Even in times of trouble couples still find time to Shine:) I wish you good luck with your waiver smile.png God Bless

thank you for your replies Nigeriaorbust and Brian1967! makes sense to use those.

as for explaining in the application the situation that led to split up, is that required or is it irrelevant to 'good faith'? i think i read somewhere that it does not interest them, only to see how we entered the marriage, not why we broke up, but I am not sure, and don't want to send things that are not relevant.. any of your input will be appriciated. thanks.

Right when you remove conditions (if there was abuse DO NOT check this box) just check the divorce box a provide the good faith for the union. The two year check is a fraud check not to see if the marriage is happy and healthy. USCIS does understand that not every marriage will work out and some marriages seem happy at first and then fall apart VERY quickly. You must provide proof of good faith certain things they will look for

1) joint lease or joint property bought during the marriage

2) joint bank account (statements) joint filing of taxes (very important)

3) household bills in both names

4) birth certificates of children born during the marriage (please note this does not give 100% proof of a bona fide marriage, it just means you had sex)

5) Letters from people that knew you as a couple (please note this is not great proof but your ex does not need to write a letter as a matter of fact do not have him write one)

6) Pictures of you together (warning I always would say use new pictures because the old ones are still in the file and it shows you did things together during the marriage smile.png

7) a divorce decree (get a certified copy from the courthouse in the county you live in) (IF abuse is in the decree DO NOT check this box you will increase the headaches)

Keep all proofs neat and organized you will need to take them for the interview, they will ask for and interview because marriage ended before two year mark, it sounds like.

Be sure to keep all proofs neat. If they want to know what caused the break up they will RFE you or ask at the interview so be prepared for that.

The I-751 instructions give you the option of including documents that "demonstrate any circumstances surrounding the end of the relationship, if it has ended". Personally, I wouldn't volunteer any of that evidence. Most people don't. If USCIS wants it then let them ask for it.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
